Hello,

I need some help... please...

We got a Request for Initial Evidence that says:

"The petitioner/sponsor's income on the Federal income tax return does not meet or exceed 125% (100% if military) of the poverty guideline. The petitioner/sponsor list their current income on Form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of current income.

In order to process your application further, submit evidence of the petitioner/sponsor's current income. Such evidence should include:

-Letter of employment containing the following:

Dates of employment,

Nature of the job,

Wages or salary earned,

Number of hours per week worked,

Prospects for future employment and advancement.

-Pay stubs or other documentation of pay for the previous 6 months."

We have a Sponsor (that is my husband) and because he doesn't meet the poverty guideline we have a Joint Sponsor (his Brother) and also his Wife because she is a household member.

My question is: do I have to Send a Letter of Employment and the pay stubs for My husband, for the Joint Sponsor or for his wife (the household member)??? or for Everybody?????

I need some help... please...

My question is: do I have to Send a Letter of Employment and the pay stubs for My husband, for the Joint Sponsor or for his wife (the household member)??? or for Everybody?????

From what I understand, per your husband's tax return, his income did not meet the guidelines; however, per the figure on the I-864 form, he met this min requirement. SO, you should submit evidence to support the number on the I-864 form, letter of employment verifying CURRENT income, and current pay stubs. IF your husband's current situation does not meet the requirement, then submit all the supporting docs on the Joint Sponsor.

That's how I would treat the case.

Ok that can be because He has a new job now that help us meet the requirements, but the last 3 years of taxes (from another job) didn't, that is why he found a Joint Sponsor.

Not a problem. I think that could very well be the reason. So, if you provide evidence showing support for his CURRENT income on the new job, and that's enough to meet the requirement, then that should be sufficient. For your Joint Sponsor's piece, you probably have already submitted evidence such as that person's tax transcript/returns, etc.

We got this letter too ... the thing about the Future Advancement though - my mother in law is our co-sponsor but she already is the manager of her work place and can't get any higher than what she is right now.

However, she can get a letter stating nature of employment, salary, position etc today from her company's staff internet, but can't get the Future Advancement bit without getting a letter from HQ - which can take weeks.

Is that info crucial to the application or if the USCIS see "manager" will they just cop on that there isn't any future advancement possible and that the job is secure?
