Which is fair enough. Immigration is a privilege and not a right. Especially when it comes to marriage based visas.

Once someone becomes a legal resident or at least satisfies the requirement of the Visa they are on, only then may they be eligible.

That fact is most new immigrants have not paid a cent in income tax in America, so why should we receive anything really.

I don't have a problem with me not getting anything, but I did have a problem with him not getting anything just because he was married to someone who had an ITN....he's been paying his taxes after all.

You're confusing immigration law with tax law which has quite different standards. With the tax laws a family is a family and in the case of a spouse who has not entered the US can be eligible for filing jointly under specific conditions, which do not require admission to the US. If you don't like that law get Congress to strike it down, otherwise have the tax burden and benefits applied equally.

But if we take your statement about paying income taxes to the fullest extent I'm sure you wouldn't have any problem with removing the deduction for children and stay at home moms as neither groups pay taxes.

We could carry this one more step, military personnel receive this benefit with a spouse who had an ITIN. I served my country just as they are now, what makes them more eligible for this exception than a veteran who is no longer on active duty?

Actually my husband is active duty and we did not receive the benefit.

Doesn't it depend on the State you live in when you apply for an SSN? For my K1 I couldn't get one until I had my EAD in my hand.
Federal law does not vary by state. That's one of the big differences between Federal Law and State Laws.

Its been a while - but I remember explicitly that I had to present the EAD card before I could apply for an SSN.

I'm truly amazed at the "I got mine, screw you" attitude that has come out in this thread, I can only hope that karma will be around shortly to give you your reward.

For some reason I thought VJ was a place where people in all phases of the process were welcome and aided, obviously I was mistaken based on the responses. Sorry to have thought it mattered that some in the process took a screwing, obviously they deserved it being married to a foreign born spouse...

like your case, nessa was a k-1 and you and i both probably went to the same office downtown on 850 NEBRASKA AVE

now if we are both the same type of case and have the same office, i'm failing to understand why you didn't get a ssn for your spouse.

None of this discussion is relavent becuase the new stimulus would not be in the form of a tax credit, but rather investment by other means in the country. Infrastructure, business loans etc.

The plan would have provided money for public works projects to rebuild infrastructure as well as extended unemployment benefits.

Yep, that's what happened to us...I figured at least my husband would get his share of it, but no...I felt bad for him.

Welshcookie - You and your husband should get your tax credit, so long as you have a SSN by the time you file taxes for the 2008 tax year (filing 2009). It just wasn't prepaid because of the ITIN.

Virtually everyone who qualified for the tax stimulus rebate, but did not receive it due to their spouse having an ITIN, has until tax filing next year to qualify (get an SSN) and get it as a credit on their tax filing. The only exception I can think of would be those that are married, filed for K-3 or CR-1, and are in administrative review that may last several more months before your SO enters the country and is able to obtain a SSN.

So the previous law as written excluded very few people, but eliminated a much larger number who use an ITIN and are working illegally.

That's crazy.....

Jundp - I am guessing that your SO did receive a stimulus package based on their 2007 filing status. correct? Now if I read the IRS site correctly, when the two of you file next spring for 2008 tax year, you will calculate what your tax credit should be (in your case $1,200 for two people assuming income is within the correct range and no children), substract any pre-payment your SO received ($600), and claim the balance ($600) as a credit. Of course, you will need to obtain a SSN by tax filing time next April.

Essentially all K-1's who entered the country and married prior to December 31, 2008 will be in the same situation.
