what exactly is it that prevents someone from obtaining a social security number for a k-1/2/3/4? nessa had hers within 6 weeks after marriage.

k3 and k4 visa holders can't get a SSN under after they are approved for permanent residency.

:no: not according to the guides. they only need to have ead, not approval for pr.

Well -- we'll see. We're into our third month of the EAD/AOS process. CRIS doesn't recognize our existence and we've heard nothing.

Spouses still overseas awaiting a decision on their admission to the US often have ITN's.

Ya know - this isn't all about those pesky greedy LPRs or abroad spouses wanting their cut (injected with sarcasm to clarify).

Families in which the USC filed jointly with a spouse without a SSN or used an ITN did not get their package either. Got that? USC's due to filing jointly in this circumstance got nothing.

Please remember, the stimulus checks were a "prepayment" of a 2008 tax credit. So if you qualify by the time you file taxes next year, you will receive the tax credit. If you received a check, that prepayment will be all you get. If you are qualified but did not get a tax stimulus check, then the amount will be added to your 2008 tax return as a credit.

From IRS.gov,

"You do not qualify for an economic stimulus payment

The Economic Stimulus Act of 2008, which authorized the pre-payment of this one-time credit, stipulates that the payment is not to be made to any of the following:

Individuals who can be claimed as a dependent on someone else's tax return;

Nonresident aliens; or

Anyone who does not have a valid Social Security Number.

If you become eligible during 2008, you may be able to claim the credit on your Tax Year 2008 return, but you will not receive the advance payment this year, since that is based on your 2007 return."

In our case, Rin and her children did not receive their EAD until August; SSNs in September. If I had filed my 2007 tax return by April 15th, we would not have received a tax stimulus check, but would have received a $2,100 credit on my return when I filed 2008 taxes next year. I actually filed a tax extension in April, so waited until I had the SSns and filed taxes in late September. Received our tax stimulus on October 17th.

So for those of you who will have SSNs by the time you file next year, you still have the opportunity to receive the credit.

I'm truly amazed at the "I got mine, screw you" attitude that has come out in this thread, I can only hope that karma will be around shortly to give you your reward.

For some reason I thought VJ was a place where people in all phases of the process were welcome and aided, obviously I was mistaken based on the responses. Sorry to have thought it mattered that some in the process took a screwing, obviously they deserved it being married to a foreign born spouse...

Yep, that's what happened to us...I figured at least my husband would get his share of it, but no...I felt bad for him.

Which is fair enough. Immigration is a privilege and not a right. Especially when it comes to marriage based visas.

Once someone becomes a legal resident or at least satisfies the requirement of the Visa they are on, only then may they be eligible.

That fact is most new immigrants have not paid a cent in income tax in America, so why should we receive anything really.
