I'm Canadian citizen got married to USC. I came her ein the US as a visitor. No intention to get married but later it happened. In I-485 part 2 question, I'm little bit confused which categories I belong to since I came here as a visitor. I'm planning to file my application for AOS concurrently with I-130. Help pls..thanks you so much.

"Have faith in God, Jesus answered. I'll tell you the truth. if anyone says to this mountain, Go, throw yourself to the sea, and that does not doubt in his heart but believes that what he says will happen. it will be done for him. Therefore I'll tell you, whatever you ask for in prayer, believe that you have received it, and it will be yours" (MARK 11:22-24)

Your answer is (a). Your spouse is filing an I-130 on your behalf. As a spouse of a USC, an immigrant visa number is available immediately to you (It just takes months of paperwork to get it!). You are concurrently filing I-130/I-485, so you are, in effect, attaching a copy of a petition that will, if approved, give you an immediately available immigrant visa number.

You check BOX "A" Based on the attached I-130.

Who May File This Form I-485?

1. Based on an immigrant petition.

A. An immigrant visa number is immediately available to you based on an approved immigrant petition; or

B. You are filing this application with a completed relative petition, special immigrant juvenile petition, or special immigrant military petition which, if approved, would make an immigrant visa number immediately available to you.

a. An immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)
