CR1 AFFIDAVIT OF SUPPORT

HELLO ALL,

YESTERDAY I FOUND OUT THAT OUR K3 VISA WHICH WAS SCHEDULE IN NOVEMBER WAS CHANGED TO CR1, WHICH IS A REAL GREAT NEWS FOR US. HOWEVER, MY QUESTION IS REGARDING THE AFFIDAVIT OF SUPPORT.

WE HAVE OUR AFFIDAVIT OF SUPPORT FOR K3 VISA HOWEVER, I AM NOT SURE IF FOR CR1 VISA THE AFFIDAVIT OF SUPPORT FORMS NEEDS TO BE NOTARTIZED AND SINGED BY THE PETITIONER.

PLEASE HELP US, I AM NOT SURE AND INTERVIEW DATE IS GETTING CLOSER AND LITTLE TIME TO SUBMIT AND SEND PAPERS TO MY WIFE. PLEASE HELP.

Timeline

If your visa was switched from K-3 to CR-1, the petitioner MUST have sent an I-864 to NVC along with a $70 fee. Have your petitioner (US Citizen Spouse) send you a copy of the I-864+Financial evidence for you to bring to the interview.

Your timeline shows petitioner sent it to NVC this past august.

As far as I know, I-864 is for AOS (CR1) and it doesn't need to be notarized. Only I-134 (K-3) needs to be. Others can confirm.

I had thought that it was the reverse, because when I sent in AOS for K3 I was told not to have it notarized. Can someone else please confirm this. Please I really need help.

THERE ARE TWO visa processes going on at the same time, CR-1 IMMIGRANT process, and K-3 NON-Immigrant process.

I-130 IS CR-1 process, when approved it gets sent to NVC which generates I-864 Affidavit of support fee bill ($70), and later DS-230 fee bill ($400) these are for CR-1 visa NOT K-3. (I-864 is NOT Notarized)

I-129F is K-3 process, when approved it rapidly passes through NVC and results is a K-3 visa interview, this requires the NOTARIZED I-234 Affidavit of Support brought to visa interview, because K-3 is a NON-Immigrant visa.

Since the K-3 was dropped, the I-864 sent to NVC supersedes the I-134 which is only used for K-Visas, you should have a copy of the Affidavit of support that was sent to NVC handy for the interview.

The petitioner had already send the Affidavit Packet which was recieved from the lawyer. It included I-1864 and NOT I-134 with other documents (tax, paystub, employment letter, joint sponsor...etc.). So if I am reading and understanding this right the interview should go fine. Since the beneficary have the I-1864 (NOT NOTARIZED) to submit. Right, so it should be ok?
