K3 right after K1

Hello friends.

Does anybody know how soon after approved K1 my then-fiance and now-husband can file K3 for me?

K1 was filed and approved in 2008, US entry was in August 2008, departure - October 2008.

Please kindly advise.

What exactly do you need a K-3 for? Your K-1 visa was approved then you entered the country on a K-1, right? You married your fiance then you left the country and now want to file a K-3?

I think I'm misunderstanding something here!!!

Did you enter the country and marry him? If you married him and left you'll need to file for advance parole.

Anyone else understanding something different?

I hope that you didn't take the rule saying you must marry within 90 days to mean that your visa was only good for 90 days. If you came to the US and did not marry within the 90 days, and then went back to your country, I think you have to start all over again.

Did you file for Adjustment of Status? If you left before that, did you file for Advance Parole?

No, we did not do that. Neither AOS nor Advance Parole. For that reason we are thinking now to file K3. Any ideas?

I'm not an expert, but I think you have to start all over with the K-3 by filing I-130 and I-129F again. K-1 is a single entry visa, and it sounds like you used that entry.

Since you're married, you can file right now.

No, we did not do that. Neither AOS nor Advance Parole. For that reason we are thinking now to file K3. Any ideas?

Why did you leave? Once you're here and married within the 90 days, you do not have to leave. You can file AOS whenever you like. There is no time limit.

I don't think you have to start over. Your husband may be able to just file Advance Parole for now to get you back into the country if it's possible. I'm not too sure of the requirements since you left before applying.

I left with my 2 kids for family reasons that will be resolved in my home country very soon.

I've read the instructions for the Advance Parole (I-131) and I think "daboyz" is correct in that your option is just the K-3. Had you married and then filed for AOS before you left the states I believe you might be able to just get advance parole, but you left first. So if the K-3 is your only option, you should be able to file as soon as you get all of the paperwork ready.
