hello all pls help us,

I came here with my 2 sons (minor) as a tourist visa,then after couple of years later i myself got married

with a citizen,now im a citizen but my kids are still on the same boat,wich is still tourist,they dont leave

with me they leave with their mom. My question is, what do i need to do in order for my kids to be a legal

or citizen do i need to file AOS also for them? pls help im so confused.dont know what to do or where to

start...thanks guys...God Bless....!!!

Are your kids still here? why didn't your spouse file for them the same time as you? I believe you'd have to file I-130 along with AOS package...(see the guides)

July 16....AOS mailed;

July 17.......AOS received
July 21.......NOA1 receipt date

July 23.......Check Cashed
July 25.......Received NOA1

July 28.......Received Biometrics appointment
Aug 12.....received RFE notice

Aug 13...Biometrics Appointment

August 19...RFE received, case resumed processing
Oct. 8.........EAD Card production ordered

Thanks a lot for the reply, yeah they are here, i got divorce with my orig wife,then got married with sombdy

else,now i am an american citizen,just wondering what would i need to do,in order for my sons only to become

a citizen as well...Thanks again...Gob Bless...!!!

Sounds like your kids have overstayed and are here illegally. If so I'd get a immigration lawyer.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

When you got married to a USC and applied for AOS why did you not file for your children at that point? You are going to have to file to adjust their status as they are here illegally.

i was scared that they might get deported,and i really dont know what to do at that point,and also i did not

want my new wife to find out that i have 2kids here with me,but now she knows everything,and this is her

sugestion about getting the kids paper work all set...thanks again...still dont know the 1st step so they can

be here legally...thanks....God Bless...!!!

How do you hide 2 kids from your new wife if they are here with you??? I would suggest you seek help from an immigration lawyer as there are aspects of your case that don't make sense. Did you deliberately use a tourist visa to enter the US? how did you hide your children from USCIS when you filled for AOS? as you have to list all children on the application form no matter where they live? If you lied to USCIS all the way through your Greencard and citizenship applications then your own citizenship is at risk.

You need to get expert help from a good immigration lawyer.

TayRivers has a good point. You technically committed fraud on your adjustment of status application by omitting the fact that you have children in the US and your legality in the US, first as a permanent resident and now as a citizen may be in jeopardy.

I can't believe you would do that to your children. I'm sorry to be judgmental but do they even have social security nos? Are they going to school? Do they have healthcare?
