i have filed an i-130 and i-129f for my husband 3 months ago and i requested an expedite for the i-129f and it was transfared to the local office for some reason , some people have told me that i wasted my time and it will not get approve becuase they will not approve the i-129f before they approve the i-130????????? :( is this true????

Not true, I have seen several who had I-129F long before I-130 approval, get K-3, and then run into a problem when they file to adjust status because the I-130 is still not approved.

What did you try basing an expedite on, there is not much that USCIS will expedite on other than perhaps a military deployment. USCIS has not had your case that long. July is not lat long ago USCIS can take up to 6 months to approve a petition.

I have seen USCIS send petition to field office to interview the petitioner.

Not true, I have seen several who had I-129F long before I-130 approval, get K-3, and then run into a problem when they file to adjust status because the I-130 is still not approved.

What did you try basing an expedite on, there is not much that USCIS will expedite on other than perhaps a military deployment. USCIS has not had your case that long. July is not lat long ago USCIS can take up to 6 months to approve a petition.

thank you very much for your answer, now i have little hope . well i requested an expedite based on medical reason. i need few surgerys in my lower back very soon and am also taking medication for my heart and sometimes i can't get up in the morning and i requested an expedite when i filed the i-129f and they sent me a letter last month saying that in order to process this case faster we have transfared this case to the local office . but good to know that it is possible to get the i-129f approve before the i-130

sorry i dont know how to update the timeline but i filed the i-129f in aug 18th and they touched it in sep 17th and 18th and the 19th and nothing ever since

heres how to fix it:

go to the top where it says "my Assistant"....put the little pointy arrow thing on it and click with your index finger.

(thats your point finger, if ya didnt know)

The second line down say "Edit / Add my Timeline ", please repeat with the little pointy thingy and click on it.

Put your email address in the little box and the little gray button that says, "Add / Edit my Timeline ".

Please repeat with the little arrow pointy thingy

the fourth (4) box down is a drop down box. click on the arrow and select your correct visa type. If you look on the left side, it will even say "Visa Type:" PLEASE choose the right one and alllllll the way down at the bottom,

They may well have transferred the case to the local office in order to have you come in and show evidence of your medical condition, so be prepared with a statement from your doctor and any appropriate medical records that may be available. They may also investigate the bona fides of your marital relationship.

Good, then probably one down and one to go. The only times I've seen cases transferred to local offices had to do with investigating bona fides.

well they deny my first i-130 i have filed in 2007 for lack of evidence and it was an attorney's mistake . so i appealed it and then i got tired waiting and decide to file a new one,so they actually sent me that letter from the local office and then they sent me another letter stated that the uscis have request the appeal back from the BIA so i got worry because i did not want the appeal to delay th new case so i will be sending a letter tomorrow to the BIA to withdraw my appeal

Of course it isn't normal to have two I-130's in the works for the same spouse. I don't know how much problem it will be. You'll have to wait until the local office contacts you to find out. I'm just saying it's important to be prepared to convince an already sceptical adjudicator that you have a bona fide relationship with your spouse.

well i am going to send the letter tomorrow to the BIA to withdraw the appeal for the first i-130 and here is a list of the documents i have sent with the i-130 and the i-129f .( rent lease in both names,joint bank account, cellphone bills in both names,joint life insurance, i added his name on my car insurance, house phone and internet bills in both names,hotel receipts in both names, letters from friends and family members,photos, emails, credit cards in both names, letters from the hotel stated that we have lieved together for 9 months back in 2006,letters from and to each ther) thats all i have and few other things and plus the standard,g-325a etc... so what do you think about my evidence?

well i am going to send the letter tomorrow to the BIA to withdraw the appeal for the first i-130 and here is a list of the documents i have sent with the i-130 and the i-129f .( rent lease in both names,joint bank account, cellphone bills in both names,joint life insurance, i added his name on my car insurance, house phone and internet bills in both names,hotel receipts in both names, letters from friends and family members,photos, emails, credit cards in both names, letters from the hotel stated that we have lieved together for 9 months back in 2006,letters from and to each ther) thats all i have and few other things and plus the standard,g-325a etc... so what do you think about my evidence?

Evidence you lived together nine months is very strong. What reason did they give for denial the first time?

Facts are cheap...knowing how to use them is precious...
