Hello! I appreciate any feedback as we are preparing to mail our N-400 package in the next week. Please excuse any repeat questions.

1. Part 7

Section A:

If my husband is filing based on the 3 years married criteria, how should we respond to the question

"How many total days did you spend outside of the United States during the past five years?"

I'm assuming we answer it as though it has only been 3 years, but please provide any input. Otherwise he's been out of the country for 2 years worth of days...

Section B:

"How many trips of 24 hours or more have you taken outside of the United States during the past five years?" Same question applies.

2. Part 8

Section G:

"How many times has your current spouse been married (including annulled marriages)?" Is this a trick question? I'm assuming we leave everything blank since this is our only marriage, but please enlighten me.

1. Part 7 Section A: Many who naturalize based on 3 years marriage simply list total days in past three years and note "Past 3 Years"

Section B: Same as above, only note past 3 years, and Make Note "Past 3 Years"

2. Part 8 Section G: You are still married??? You count your current marriage the answer will be at least ONE time.

7C. is the only question that makes sense:

"List below all the trips of 24 hours or more that you have taken outside of the United States since becoming a Lawful

Permanent Resident. Begin with your most recent trip."

And that's what they really want for answers A and B, how many days have you been out of the country, since becoming a Lawful

Permanent Resident and the total number of trips that constituted those number of days. And it's not the last 3 or 5 years if you are applying 90 days before your 3rd or 5th green card anniversary. At your interview, you will be asked if you made any extra trips outside of the USA lasting 24 hours or more since you sent your application in. So would note,

"How many total days did you spend outside of the United States during the past five years?" to "How many total days did you spend outside of the United States since becoming a LPR."

Section G:[/b]

"How many times has your current spouse been married (including annulled marriages)?" Is this a trick question? I'm assuming we leave everything blank since this is our only marriage, but please enlighten me. Is a trick question in the sense you have to list the citizenship of all previous spouses, and they may get suspicious if you married say 100 aliens. But they really want to know the total number of marriages your spouse had including your present marriage.

You would think by now they would have corrected this form.

I'm probably going to sound like an idiot right now - but this is important so i have to ask.

I am the US citizen and my husband is my first husband and he is the applicant. If he answers "1" to the question of:

G. How many times has your current spouse been married (including annulled marriages)?

The remaining questions would all be about him (the applicant). And the tone of the following questions assumes that we are no longer married as it speaks of the marriage as a "prior" one. We were intending to leave that blank because it doesn't seem applicable.

Okay this is your first and only husband, right? But are you his first and only wife? If the answer to that is yes, just put down one and that is the answer they want.

Ironically, when I was going through this mess, had the same questions, and contacted my immigration attorney, I had one previous marriage, wasn't a good one, but still counted plus the marriage to my alien wife, so I had to put down "2". And my previous marriage was to a natural born USC. No problems for me. I did a massive net search to find an old copy of the N-400, I didn't save it, for me that is history, but had no problems with any of the questions. Figure that is what we get when a Cuban refugee is put in charge of the USCIS, do have a much better guy now, but guess he didn't get around to rephrasing the questions on the N-400. We answered the last five year question literally the way it was asked, that was not held against my wife at her interview. She only replied in her sweet loving way, they should have asked how many trips has she made and was out of the country as a LAWFUL PERMANENT RESIDENT, but they didn't ask that. Her interviewer changed the form and went on.

OK so this is both of our first marriages. So basically we are saying that there has been one marriage and then when it asks for the previous spouse info. we simply put N/A becuase there is no prior spouse, just the current one.
