What will happen?

I went through the K1 journey, so am not too sure on the procedures for a K3....

A friend of mine, however, is over here on a three year J1 visa (and yes, he will have to waiver the 2 year residency). He is getting married to his (US Citizen) fiance this december.

What would the procedure be? Will he have to go back to his home country once the student visa is over, and have an interview? Or will he just adjust his status and remain in the country whilst he applies for his green card adn continue his studies?

Thanks.

Sounds to me like he should avoid going back to his home country at this time, since then he would have to file I-130/I-129F applications and be separated from his wife for a long time.

He should make sure that he is eligible for the waiver and then file concurrent I-130/I-485 (if that is still allowed) applications after marrying. It's better of the marriage and I-130/I-485 applications are filed before the J1 visa expires in order to maintain a good track record with USCIS.

He might have to make it clear to immigration officials at some point that the J1 visa wasn't obtained before he had intentions of marrying.
