hi guys,

i need your help again, my fiance got hour second Rfe and they ask a letter from him requesting for a waiver..

because he filed a petition a year ago, to his ex-fiancee, but it did not work out, his fiance was denied, because she had a petition also before but her fiance did not marry her, so she overstayed there, and that's the cause of denying there petition... guys, can you give me an idea what are the possible things to do get an an NOA2 since we are having a problem like this...

He simply needs to write a short letter to the USCIS, which includes his receipt number, requesting a waiver of the guideline that discourages filing more than one K-1 petition in a two year period. The letter should explain in a brief paragraph what happened to the previous engagement. It will take about 30 days to process this letter. The instructions for submitting the petition explain that the request for a waiver should be submitted with the petition itself.
