Question on buying a home

I need your opinions on something.

I may be buying a house in a few months. The catch is though that my mom might be financing it because I can't get it on my own. The reason I am asking is when Darcy gets here and we get settled we are going to apply for a mortgage and buy the house from my mom. Will this cause a problem when we go for the AOS interview when he gets here if we are living somewhere that isn't in my name? We won't be leasing it from her per se. I will be making the mortgage payments its just that the mortgage will be in her name.

I am just trying to think ahead and not cause any grief for us in the future.

I don't see how that could cause you any problems... Lots of people don't own their own house, especially young newly-married couples! If posession of a mortgage was a prerequesite for AOS we'd be up the creek without a paddle because we can't get one. If you are really worried, put it in writing so you have something to show them... but if it will help you out, go ahead! I wish we had such obliging relatives...

I was just concerned because like now for instance the apartment I am leasing is in my name. I won't have anything in writing but I may have my mom draw up something just so I can have proof.

you can get pre-written leases and such at Staples and Business Depot, they may also have lease to own as well.

My alien wife is not on the deed or the mortgage. Not an issue for her adjustment of status. But, her not having a credit history in the USA was an issue with the mortgage company - which is why it's 'my' house and not 'our' house.

Or even just a rental agreement. I'm presuming (perhaps incorrectly) that you and your mother have different last names. How do they know she's your mom?

Years ago, my mother did the same for me. We drew up was what called a contract for deed. It stipulated we were paying a monthly payment towards the balance of the home, but if we chose to walk away the payments made would be considered rental instead. So either way you would be covered.

Well I go tomorrow about financing....

My mom is going to be the co-borrower. We will see what happens from there.
