Tips for K3 starters is DON"T start the K3 but go with the CR-1 all the way solo. CRs have been moving fast and are MUCH MUCH better visas than K3s.

i am new here in this site, but anybody have an idea? we filed for I-130 its approved and then we filed I-129F for K-3 but after my interview i was denied, but the consular officer told me that where going to appeal, its possible that we can change the K-3 to CR?

EAD APPLICATION:

2009-01-10 ----- E-filed EAD Application

2009-01-20 ------NOA1 Receipt Notice

2009-01-22 ------Biometrics appointment recieved by mail

2009-02-11-------Biometrics Date (done smoothly)

2009-4-15 -------- EAD Approved

2009-4-24 -------- EAD Received by mail ( yyyeeeeessssss)

Timeline

This refers to the requirement for K1/K3 Visas in the Philippines. Here, they need some document verification for the visa application. Delbros is the courier company that handles the verification process.They're the ones coordinating with the national statistics office (NSO) as to whether the documents you've submitted to the embassy (birth and marriage certificate) is authentic or not.

Here, when you're petition has been approved and you're already eligible for interview, you need to pay a fee payable to Delbros for document verification.

im also from the philippines and i was interviewed for a k3 visa (september 4th) but i filed both I-130 and I-129F...im one of those waiting for the visa from DV at NSO...my husband called last friday and Lorraine of US Embassy informed him that my visa will be released within 5 working days....like you, we filed the petition ourselves and i was just the one reading all the instructions from the US Embassy website and helping my husband out on the process...we decided to go for K3 as advised by my friend who works for a law firm in LA...he confirmed that based on the cases he handled, k3 really gets approved faster and coming from him too, he advised us not to get a lawyer coz it's just a waste of money since every information maybe read throm the embassy website...

i just became a member of VJ last septmeber 22nd when i got worried about the delay of my visa due to docs verification....i tried to search NSO documents verification and it lead me to the VJ site...i agree, VJ ste really helped alot...i kinda found a support group in here, especially on the post "August interviews, visa update as of Oct 7" ( i think that's the subject or something like that)....almost everyone there are from the philippines, almost same timeline as mine and ranting about this whole DV process....

i really appreciate you starting this post coz i think this will really be a big help for this starting on filing for a K3 petition...

i know that you cannot change from CR/IR to K3 but vice versa, im not so sure...

did you ask the grounds for your refusal for a k3 visa? i know that they refuse a k3 visa if you have already filed for an IR/CR and is already in process then you file for k3...once you receive your NOA1 from the I-130 you filed, you submit a copy of that NOA1 with an accomplished I-129F immediately...this signals that you are applying for a k3 visa...but once time has elapsed after NOA1 and you failed to submit the copy of the NOA1 and the accomplished I-129F, that means you are pusrsuing for an I-130 or CR/IR1 visa...

haole, i got confused, too, when you said go with IR/CR1?

i remember my IR/CR1 (I-130) being processed simultaneously with my K3 (I-129F)..i even submitted and signed the DS-230 (the form which has a part you leave to sign with the consul for your CR/IR visa or entry as an immigrant during your interview)....but i got my medical appointment a few days after we sent the DS-230..my medical appointment states that my visa type is k3..so, when i got done with my medical and i went for my interview (that would be k3), i was informed that my docs submitted with the DS-230 are not yet with the embassy....since my husband was in a hurry for me to get to the US, he wanted me to pursue k3 since it's the first one that came in...

now, my question is, since im on the process of waiting coz my docs just got back from NSO after DV and Lorraine of US Embassy informed my husband last friday that my visa will be in within 5 working days, should i immediately file for AOS when i get to the US? or i was thinking should i still pursue the IR/CR visa since my K3 will be valid for 24 months and i should change status before the 24th month...i was thinking of not filing for AOS and just inform the USCIS that we're interested in pursuing the IR/CR visa and i'll just inform of them of my change of address....please enlighten me....though, i want to be able to work soon, too...i want to know the pros and cons of this...

haole is right about your wife not to be allowed by any airline to fly on her 7th month..it's a general rule for all airlines...the reason behind is there is a big possibilty for those women on their 7th month of pregnancy to give birth, most pre-mature births are on 7th month...

my husband is a pilot so, i know....

my cousin, a flight attendant of cathay pacific, told me that it's also because the chinese believe that it's lucky in business when a child is born in an airplane so, as a sign of gratitude of the company, they give the child a lifetime pass (free airfare bound anywhere) to any child born in any of their aircrafts....but, they dont want people doing this for that so, the rule they follow....NOONE ON PLANE ON HER 7TH MONTH OF PREGNANCY....

Haole, when you say go with CR-1 all the way solo, do you mean to not even send in the 129F form for K-3? Can't you just send in both, and see which one comes in faster. Or are you suggesting that by not even submitting for a K-3, your CR-1 will move quicker? From reading the different posts, it seems like you are still eligible for the I130 even if you apply for K-3 as well. I guess somewhere down the road you have to make the decision of which one to pursue. Correct me anyone if I'm wrong.

Yes you can do both. The reason I said to go all the way solo with the I-130 was USCIS was holding back the I-130 if you submitted the I-129f. Doesn't look like they are doing such anymore tho.

I'd do as you said. Don't adjust status and go back and get the CR/IR. If you are eligible for IR I would jump on it BIGTIME!!!

You can file a I-765 for a EAD if you want to get a SSN and work.

i'm sorry haole,

i got a little confused..please walk me through it...

so, u suggest that, when i get to the US on a K3 visa, that i dont adjust status but instead continue pursuing the IR1 and just inform USCIS of my change of address/residence? i know that my CR/IR1 application is still active since my husband has received correspondence from the USCIS regarding additional docs to submit with the DS-230 (which we already did) before i was scheduled for the k3 medical requirements...

i'm sorry to bug you with this repeatedly coz i get so confused...

cost implication-wise, how much is EAD without the AOS? how much is AOS? i know that if you file for AOS, you do not need to pay for EAD, right?

EAD is $340. AOS is $1010. Normally takes no more than 90 days for EAD. No for sure processing times for the AOS. Some people get GC in a few months and some sre still waiting after a year.

How long have you been married?

No need pay for EAD if you file for AOS.

Yep!

If it takes 11 months to get your visa you'll get a 10 year GC as you will be a IR then.
