Canadians and the i-94 form.

I am getting very different reports here and other places regarding Canadians who occasionally do not receive a i-94 form at the border. I did not. I entered a year and a half ago, and am almost positive I didn't.

I came in via Amtrak train at the Montreal Calis border where the Border patrol boarded the train to inspect us.

Are any other Canadians in the process of filing in the same situation as me? Or were not issued this form?

I am confused as to what I should put down on the forms requesting my i-94 number. I don't want it to get to the USCIS just to have some uninformed paper pusher decide that I forgot that part and to send it back to me. I mean, has anyone here filed without this number?

07/23/2008 Married in Las Vegas, NV.

10/03/2008 Mailed i-130, i-485, EAD to Chicago.

10/10/2008 AOS packet accepted & signed for.

11/02/2008 Received 2 NOA's, one for each application.

11/29/2008 Received a Yellow RFE regarding i-485. (Need additional Tax Info.)

12/10/2008 Mailed back RFE with required material from sponsor and joint sponsor. Sent Priority.

01/14/2009 Received ASC Biometrics Appointment Notice.

01/01/2009 ASC Biometrics Appointment Completed.

Yes! Lots of people have. If you do a search in the main AOS forum (this subforum is pretty new) you will come across quite a few. I thought, at first, I would have to file for a "replacement" I-94 but soon realized that was a waste of $300+ because I was never issued one in the first place and they would not "replace" something that was not issued.

Everywhere it asked for the I-94 I wrote "none issued—Canadian visitor". I never left anything blank. Same for the A# (that is the number on the I-94. I wrote "No I-94, Canadian visitor". This is the right process. USCIS should know this and the one example I have seen recently where someone was issued an RFE for this has got to be a dumb mistake on the part of USCIS. I have NEVER received an I-94 crossing the border.

I did write a cover letter for both packages explaining that I have listed no I-94 nor have I included it because I was not issued one since....yes, I am a Canadian Visitor! It felt very repetitive but I just drove the point home at every opportunity.

Concurrent I-130 and AOS

Nov 30 2007 - I enter US as a tourist to spend the ski season with my sweetie and figure out what we both want outta life - we plan on ending up in Canada, but...

Jan 30 2008 - We get married in Vegas! We decide to stay in the US.

Feb 08 2008 - File I-130, I-485, AP and EAD

Feb 11 2008 - Package arrives in Chicago

Feb 19 2008 - Receive NOA 1 for everything except I-485. NOA date Feb 15th

Feb 19 2008 - Touch I-130, AP, EAD

Feb 21 2008 - Receive I-485 NOA 1. NOA Date Feb 15th

Feb 22 2008 - Receive Biometrics notice, dated Feb 20th, for appointment March 11th

Feb 27 2008 - Walk in to Denver field office and have Biometrics taken early as the 11th March I'll be away

Apr 16 2008 - EAD card production ordered

Apr 16 2008 - AP approval sent

Apr 21 2008 - AP received in mail

Apr 21 2008 - EAD card production email received again - strange

Apr 24 2008 - EAD card approval notice sent email

Apr 26 2008 - EAD card received

May 03 2008 - Interview notice received -June 27th

May 22 2008 - Touch on I-485

June 09 2008 - I-130 finally shows up online and shows a touch that day, so does I-485

Jun 27 2008 - Interview - approved, stamped, received card production email. Ya-hoo!!!!

July 10 2008 - Card received

Total time from filing - approval: 4.5 months

MOVED TO SAN DIEGO!!

Lifting of Conditions

June 11 2010 - Package mailed

June 16 2010 - NOA date

July 2 2010 - Bio letter received - July 27th date

July 9 2010 - Early biometrics walk in San Marcos CA

Sept 16 2010 - Card production ordered

Oh and I meant to add, I tried doing research about this outside of VJ and I too found confusing conflicting reports. There is just nothing out there. But the fact is, Canadians rarely receive the I-94, and that does not preclude you from filing from visitor status. The applications are just not tailored to our situation.

I would also ask this q in the Canadian forum becasue there are quite a few active posters there who did the same thing as us, to set your mind at ease (there will also be the usual confused people who say you have to go home and file a K visa—they don't all understand the concurrent thing, which is understandable if you did not go through the process in this way. Just pick out th useful advice from th confused advice:)

We did what bluegreen did - wrote N/A Canadian anywhere the I-94 or A# is requested. Once you get your NOAs, you have an A# for future forms.

The only time I have ever received an I-94 and then only twice was when using my A/P.

BTW, if you have been in the US for the past year and a half, don't bother to apply for A/P - I-131 - as you could be denied reentry due to the overstay. When I first used mine, the border guards were very questioning regarding my dates, status and intentions.

We're awaiting the 'review' of our 'approval' after our interview on Friday. :thumbs:

USA Arrival-Departure Record (Form I-94)

Not Applicable to Canadian Citizens

Canadians who travel to the United States as tourists or on business generally do not need a Form I-94.

This page is included here for the benefit of visitors from elsewhere who are traveling to both the U.S. and Canada.

09/28/09 - Medical Exam and Vaccinations for I-693

09/30/09 - Medical Results (everything fine)

10/05/09 - Sent I-130 and concurrent I-485

10/16/09 - Checks for $1010 and $355 cashed

10/19/09 - NOA1 received for I-485, I-130, I-131 and I-765

10/20/09 - Biometrics appointment set for November 11th -

11/10/09 - Biometrics appointment (30 minutes, including wait time) -

11/23/09 - Received email stating that Employment Authorization card production ordered

11/28/09 - Received I-512L (Authorization for Parole of an Alien Into the United States

11/28/09 - Received I-797C Notice of Action scheduling Jan. 19, 2010 interview

01/19/10 - I-485 interview with my wife, which took about 30 minutes. APPROVED! Green card in 2-3 weeks, he said.

I have been filing the questions about my I-94# and A# with 'NONE/CANADIAN', but I was wondering about the NONIMMIGRANT VISA NUMBER. Particularly, the I-485 form in Part 3.

Does this also not pertain to Canadians and is this a number that would have been on a I-94?

If you entered as a Canadian visitor, you would not have received an I-94 nor would you have a non-immigrant visa number. You do not have a visa :) . The non-immigrant number would be on the I-94W for a visa waiver country or on an actual physical visa such as a K-1 or a K-3 visa for family based 'non-immigrants' who will become immigrants after their arrival, or on a B2 visitor's visa for countries that require a visa, etc. Just put 'none/Canadian' where it asks for the non-immigrant visa number and you will be fine.

Hello!

So, has anything changed in regards to I-94 rules??

I am a Canadian, got married(to US Spouse, in NYC) in April of this year and have been going back and forth between Canada and the US since.

I do not have a K visa, only b-2 visitor.

Recently sat down and collected all the papers and documents to file I-130 + I-485 together.

I received an I-94 when i flew in in april, but during all my entries including my last entry in October(by car) i wasn't given a stamp or number(94).

According to the i-94 website, the i-94 number is expired.

What should i do?

Should i write "visitor canadian" on my forms when it asks for i-94? and how can i prove when i came into the country(if i dont have stamp)? !

I appreciate any help thank you !!!
