No Online Tracking After a Month and Half - Should I worry? VSC, Lawyer Concern, Timeframe,

Hi Everyone,

My case seems to be going as normally as anyone else's with one glitch - the online tracking.

I am applying for the K1 visa, I-129F, from the Vermont service center. I hired a lawyer (didn't want to take any chances) and we sent in all our materials on Sept. 2nd, 2008. Shortly thereafter my lawyer received and I-797C NOA 1 form dated September 4th, 2008. I eagerly looked up our tracking number online and couldn't find it. I was told my my lawyer and then the USCIS when I called, that it usually took a couple weeks to enter into the system and could take up to a month. When the people at USCIS looked me up by name, they found my case and that gave me some peace of mind (so nice to hear them read of my fiancée and my names and other info). After 4 weeks I called again and they told me to wait another month. About 10 days later I received a letter in the mail saying that they were acknowledging my problem with the online system and the IT department would look into it. We are now at 6 and a half weeks and no online tracking. I called my lawyer to ask what number was printed on the back of our cashed check, but she told me that she would get back to me when the secretary had time to go through all the September bills/receipts.

I would like to be able to see stuff online, however, if everything is going smoothly, than I'm not too worried. Should I be worried? Does it not showing up online (when many other peoples cases are) mean that my package hasn't even gotten to that stage of the game, or was it just an oversite and it's still going through the normal steps? Is my package lost under someone's desk at USCIS?!?!?

On another note, my beautiful fiancée is 15 weeks pregnant and we sooooooooo want to be together ASAP (she's in Brazil and I just went down there for 5 days to be together, get and ultrasound...). If our case goes through in 3 to 4 months as it seems many do at the VSC then we should be cool, she can travel up until the end of February/beginning of March - will we make it?!

Lastly, my lawyer seems very lax (but professional about everything). I went to her office with a TON of documentation and she took little of it (took bus ticket receipts without our names on them to demonstrate that we had travelled in Brazil together but left the plane tickets with our names on them out of what she sent it). She is experienced and said that she knows what the USCIS wants and needs to see, and doesn't need to bombard them with millions of documents. She I take a deep breath and rest assured that she knows best?

Don't let online tracking spoil your next few months. The good news will come to your lawyer when the USCIS is ready...not a day sooner. The online tracking system is bogged down, and basically unreliable for many filers. Be patient & good luck to you both.

I would not worry to much about it, it seems that it is not that relyable, as some people have recently received the actual noa2 in the post and on the USCIS page it is still showing pending.

Haha, taht's not recent... USCIS online tracking sucks. You can call their hotline and check your status that way. If you have a #, they read off your names, it means you are in teh system.

AOS

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

Don't worry too much about the online tracking, although it is good to be able to keep an eye on your case. We filed for my K1 visa back in April, and have since received packet 3, but the USCIS online tracking still has it at the California Service Centre! It appears online tracking isn't very reliable.
