I didn't put my kids on my tax

I got two kids whom I am paying for child support for, but the thing is I have not claimed them on my taxes. Do I still put my children as dependents on the 1-864 form since the children are living with the mothers and I don't claim them on my taxes? If I was to make them my dependents on the petition it would make it total four with my two kids, my wife, and I making the poverty line 26,500. Can someone answer this question for me. I am filing for the CR1.

How Do I Count Household Size?

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be as ponsor, you may include additional relatives (adult children,parents, or siblings) as part of your household size as long asthey have the same principle residence as you and promise to use their income and resources in support of the intending immigrant(s).

im also wondering about this since my husband pays child support but the ex wife claim her daughter as a dependent on her income tax..

how can we determine our household size? my son, my husband and me? or do i have to include my husbands daughter?

my husband told me that only one parent can claim the child... the mothers are the one who claim their child to their tax and not my husband... so the total household is 4..

A divorced parent's dependent children are members of his or her household, even if they live part of the time with the former spouse. A parent almost always has a legal obligation to support his or her children. Although only one of the parents may be legally entitled to claim the child as a dependent on tax returns (1040), the child must be considered as part of both parents' households for purposes of the Affidavit of Support, unless a parent can show that he or she no longer has a legal obligation to support the child.

So yes, include all children even if not listed on the tax returns. I hope this helps.
