Hello VJs,

I have a question, as soon as I will be in US and get married to my fiance can I apply for a working permit without filing for the AOS yet? I know everyone here knows that AOS is a lot of money ($1,010), it could be better if my fiance and I will file the AOS 2 months after I get to US as long as my K1 will not yet expire, right? All I want to know is, Is it possible that I can get a working permit without the AOS filed yet?

Any help will be greatly appreciated.

Just to let you know that some POE do stamp you with a temporary permit to work for 3 months, one of those POE is New York but it is not guaranteed, and some employers are not keen to employ you with the temporary one.

You definitely can apply for EAD alone, but that way you'll be overpaying close to $400. See, when you file AOS, EAD and AP together the EAD and AP are free (included in the $1010 fee). Now, when you file separatly you pay the EAD filing fee right after marriage, and than $1010 for AOS. Hope it helps :) Edited by Ana&D

In USA you don't need a 4 year college degree to work. Unlike in PI where one needs a 4 year college degree to get a job as bank teller, flight attendent, or even answering phones.

There are so many people here illegally ( 12 to 15 million illegal aliens) that work under the table. I don't think it's right, but the US Government tend to ignore it and let it happen.

yes, but even if you get it in time it will expire with your I-94.... 90 days after entry.... $355 for maybe two weeks of authorization before it expires....

True, it's best to apply for the EAD/AOS right away. You'll get the work permit in eight to twelve weeks. Meanwhile, if you want to work "illegally" for cash, it's up to you.

As to Tallcoolone's remark about a four-year degree being required in the Phils to obtain any kind of decent job, it seemed to be a put-down and certainly is not true. Having a college degree is certainly helpful, even here in the U.S., but not required unless the job requires some government certificatiion such as nursing. I think Tallcoolone has an attitude problem of some kind.

I think unless you get the temporary EAD stamp from the Airport (or two) that do it ..occasionally, it would save you money follow Payxibka's advice.

You heard wrong... by itself, SSN is NOT work authorization. A K-1 receives a SSN card with "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" printed on its face....

This is true. I got the EAD stamp when I entered at JFK and found a nice job here within 2 weeks. I never told them that my EAD stamp would expire along with my I-94 after 90 days and just thought that if they don't figure it out, I'll keep working there. But companies are not stupid and they know about that stuff. So on the day my I-94 expired, they kindly asked me for an EAD renewal, which I didn't have yet. My SSN alone was not enough to keep me working. So now I'm not working while I wait for my EAD card. Fortunately the company where I worked is willing to hire me back so I was lucky.

One very important basis on an EAD is your I-94 validity. Since a K-1's I-94 is only good for 3 months, it would be hard, especially the EAD process alone will take about 3 months. You have no choice for now, but to do AOS. Do not risk your immigration status by working illegally. Take your time and enjoy the USA. When you start working -- I tell you, it can be tiring.
