--- Ok I am confused.... If my wife makes 125% of the poverty line. Does she need to send the last 3 years of taxs. She files alone last year so her tax papers say 19,900 annual... She made over 125% for two ppl last year. But now we are married and i dont know if this well play a big factor on our visa. She makes 30,000 a year now. What do we do? So confused about all these support things.

Only the most recent tax year information is required, however, she has the option to send the last 3 years, if she feels those years will also help demonstrate her ability to meet guidelines. $19,900 annual does, as you said, meet the requirement for a household of two- if it's just you two, you should be fine with that. Make sure she includes an original letter from her employer stating her current salary. Read guides here, and she'll be fine.

yes this meets for two ppl her and her daughter. she filed way before we got married. but now for 3 ppl (me, her and our daughter) its 22,000 a year that she needs to make.

Read question 19. "I have filed a Federal tax return for each of the three most recent tax years. I have attached the

required photocopy or transcript of my Federal tax return for only the most recent tax year. "

The petitioner must show that he/she filed for the last 3 years. only the last year tax papers photocopy or transcript is required. hope this clarifies the confusion.

there are two issues here:

  1. providing tax transcript for the last year
  2. filing taxes for the last 3 years
the question is, can a person who has very high income for the last year (ex. 2007) not to file for the two previous years (ex. 2006, 2005)?
