I arrived here in Texas AUG. 4, 2008 and got married in Las Vegas October 3, 2008.

K1 visa will expire on NOVEMBER 1, 2008.

I sent mail to Las Vegas county recorder OCT.8, 2008 for a request of Certified copy of marriage license.

Kept on waiting and today Oct.17,2008 i received a reply from them. takes 10-14 days for their reply. Unfortunately their reply tells that our wedding was not in their record yet.

QUESTION:

Is it Ok to file the Adjustment of Status after the I-94 expires/ K1 visa expires though we are already married?

As long as you marry within the 90 days of the I-94 you will be fine. Many have to delay to file AOS until after I-94 expired for many reasons, (Waiting for Marriage Cert, Financial, Vaccination supplement, etc..)

NOTE: K-1 visa is VOIDED upon entry it essentially "Expires" the moment you use to to enter the USA, at that point the 90 day I-94 clock starts. The Visa expiration is the date that you have to enter the USA by, it has nothing to do with when you have to marry or file AOS.

There are many k1 who filed AOS after I-94 expires .

You'll be fine as long that you got married within 90 days upon arrival. We filed our AOS 2 months after the expiration of my I-94 and we didn't had any problem about it.
