hello just want to ask you people about this thing.me and my fiancee have been dating for almost a year now and during this time he is still waiting for the divorce from his previous marriage to be final.The divorce was final on feb 27,2006 and he came to meet me in march 24,2006 . So my question to you is will the fact that we meet each other so soon after his divorce affect the outcome of the K1 visa petition?

06-06-05=met in filipinaheart

03-24-06=met in person......and ohhhh my goshhh its so amazing were both nervous that time to see each other but were so happy kisses and hug for the first time.....hehehe!!!

03-29-06=He met my family....

04-12-06=Even we dont like to be apart but we have to bcoz he have to go back to his homeland...ohhh start crying every moment i remember him.....

A petition requires that you are free to marry and that you have met in person. If the divorce is final and your have met in person.......then you subit the evidence to support that.

As long as you have the proper evidence to prove that the divorce was final and that you within the past two years(which you have) than you should be fine!! Good luck!!

06/17/08- package sent to California

06/19/08- California receives package

06/19/08-NOA1

06/28/08-Biometrics appointment

07/28/08-touched

09/01/08-received non conditional green card

Nope...my divorce took 2 years- we were married 3 weeks later...as long as it's final, and you have met your fiance with a K1, you are good to go !!

Well my fiance had his interview yesterday and thats what she was asking about is why she wanna marry so soon after divorce? And also our age difference. Those are the rules that as long as you are free and clear to get married you are good to go but thats bullshit cuss they still hold it against you.

Two seperate issues.

Being free to marry and showing the proof of that is one of things that is needed for a petition to be approvable.

At interview one may be asked questions about that or anything else they wish to, but its not a reason to deny a visa. A conof has to have reasons that USCIS where unaware of when they approved the petition in order to deny.
