how to solve the overstayed status?

Hello,

I have a friend here in USA, she went here under K1 visa(fiance visa). On january '08, She arrived here in USA. She just stayed for one month with her fiance. She decided to leave him and not to marry him because the fiance was changed and she's not compatibe with him. Few days she arrived there she told the fiance she wanted to go home and didn't marry him and guy said he don't money to pay for the palne fair,supposed to be that his obligation. And then, the guy said, "you should marry me 'coz I spend my money and time to file the visa". The guy always said no moneya dn always said also very expensive,running out of money. When my friend told me that, he was "bullshitting" my friends life. (SORRY TO SAY THAT WORD BUT HE TRULY PISSED ME OFF). He wanted my friend to work as under table since they are not married yet. She refused. So that she can leave in that house, she told the fiance to visit her friend and after couple of days she will come back and they will get married. She gave that kind of excused. She didn't brought all her things so that the guy can't sense she will not go back. If she's going to tell the guy the truth,I am pretty sure the guy will not allow her to leave. To think, I bought her ticket supposed to be it was her fiance responsibilty but as what he said all the time he dont have money,he was broke and running out of money,very expensive..many excuses that was irritated to my ears. When she leave there, the guy just gave her 10$ pocket money. Oh, lord of mercy. And guy gave his threatening words, he said "i will call my FBI friend if you will not come back. When she arrived at her friend's house she called the guy and she broke up with the guy..I understand her side that she don't want to go home whatever happened. I felt mercy with her and wanted to help but I don't know in what way, I can't let her to stay in my house coz I am afraid with that kind of situation. I hope anybody can give their comments,opinions or ideas what I am going to do to help my friend or what friend going to do???

When she broke up with guy, the guy get mad on her and threat her, saying bad words, terrorizing her and scared my friend. I just told her to keep those emails or offline messages....Those people who have a good heart and good soul I need your help..As a friend I want and wanted to help her..Pls give me your ideas,opinions and comments..thanks to all!!!

It extrememly unlikely that any relief is available to her. She didn't get married so she is supposed to leave the US. She didn't. Now she has overstayed by 6+ months, which will ban her from entering again for 3 years. She cannot adjust status while in the US, even if she marries another citizen. She could consult with a good immigration lawyer to see if she could get some type of asylum, but it is highly unlikely in this case. She never married the petitioner and she wasn't abused. She stayed without getting married and that violated the terms of her visa. She is no considered unlawfully present and subject to deportation if she is picked up by ICE. A tough situation, but she should have returned home within the 90 days if she didn't get married.
