Hi guys, here is my situation. my wife's income is not that high, and she might get a promotion by the begining of next year. Now her net income is between 1200 to 1300. I do not think it would be enough for supporting both of us. I am making the same money, but I working with my unauthorized ssn, that is why I do not think, that my affidavit would be counted. Does anyone know that if I file for AOS in next year or in two years, is it bad? do you have to file right after you get married? what would you suggest?please, I do need your help in this case, I am so confused,.

Thank you very much for your support

What visa did you enter the US on?

You don't have to file right away. But, basically you are in status limbo. You cannot do anything legally until you file.

What if she doesn't get that raise?

Is there no one you can ask to co-sponsor and get it over with?

Life's just a crazy ride on a run away train

You can't go back for what you've missed

So make it count, hold on tight find a way to make it right

You only get one trip

So make it good, make it last 'cause it all flies by so fast

You only get one trip

You can file just the EAD (I-765) so you can work LEGALLY. Then when you do your AOS next year, your income could be counted. I would not mention to anybody that you are working illegally. That could get you in some serious trouble.

The downside of doing this is that the EAD will cost you $340, since it's not applied for together with AOS. Then AOS will still cost you $1010.
