Driver's license... expiation dates-AOS status?

My wife today had her road test for her license. The instructor wouldnt even take her out because the DMV on her permit stated she was a temprary visitor which expired in October although the permit itself was valid for another year. NY state by the way..

I was told to go to go to the DMV and have them issue her another permit without or an extended temp visitor expiration date. The problem is that I have no paperwork or proof she is here legal until her Greencard comes. Even if work authorization comes (EAD) first is that proof of status?

I can show the now expired K-1 and our marriage certificate but that doesnt prove anything.... What to do?

This is another piece of the complicated and not at all senseful process of immigration. Just like getting a EA stamp at JFK and then having to stop working till EAD.

Is there something we can show the DMV to get her a new permit so she can get her license?

Until she gets her EAD she cannot drive. Then she'll have to apply for SSN. NJ/NY both require SSN card and valid status (legal status) so she'll have to wait period or if no EAD is given and they give her the GC (that is also valid)

We aleady got her S.S. card which is a requirement for the new first time issue permit for someone in NYS. The permit is valid for 2 years but in bold red writting it says temporary visitor **/**/08

Her status is what is important here. Once you married, her temporary status actually expired. She's pretty much in limbo until she can prove her legal resident status.....that is the AOS.

It beginning to be the norm in most states now. Same with Colorado, they won't even let you get a driver's permit until you have at least the EAD card.

Yes, go back when she gets the EAD and it won't be a problem. Is the permit in her maiden name?

The permit was issued in both our names i.e. her maiden as the middle and mine as the last with a hyphen

That's correct. Once she gets at least her EAD card, she can go back and get everything from the DMV. Once she gets here green card, she can go back again and have the expiration changed.

Hate to dig up an old thread, but this is relevant. When applying online to make an appointment, FL DMV has three status selections:

U.S. Citizen

Immigrant(Resident Alien)

Non-Immigrant(Non-Resident Alien or Visitor)

She currently has her EAD and AP but still waiting on GC pending AOS approval, so I have read that the EAD is what will suffice for government ID. Which selection should I choose then?

I am from NY too. Filed for AOS from here. Since I am adjusting from B-2/B-1, I had to wait till I got my EAD, then apply for SSN and the first time I showed up at the DMV with my SSN, they turned me back saying they need to see the Actual SSN Card. Had to wait another week till the SSN Card arrived and applied for a Permit. Now My permit says Temp Visitor too, but is valid till the validity of my EAD card. I will be applying for a Road test now, which i have found out takes about 4 weeks of waiting. Dont know if this Temp Visitor thing will be an issue for me as well.

This is state specific. In Vermont we used her I-94 (unexpired at that time) our marriage license and the I-797C for filing of the AOS. She was issued a drivers license valid for 2 years (the term of her CGC). Vermont requires you demonstrate that you can remain legally for a minimum of 180 days and then will issue a license not exceeding your authorized stay. You "proof" she is legal is her K-1 visa, your marriage license and I-797C letter for AOS

Maybe it will work in NY also,you can only check, but you DO have proof she is here legally

Maybe every state's DMV is just as confusing, but on the FL DMV website, there is this statement:

Original Driver License or Identification Card Florida law requires identification, proof of date of birth, proof of residential address, and proof of social security number from all customers before a driver license or identification card can be issued. The name assigned to the social security number must match the name that will appear on the Florida driver license or identification card. If you have recently changed your name, update your records with the Social Security Administration before you apply for your license or identification card.

I read that as needing a Canadian birth certificate, a bank statement with her current address, her Social Security card, and her current Canadian license. Am I mistaken? The "greeter" at the local DMV told us that the license would be granted in her married name so long as the piece of US government-issued ID was valid. Her EAD which she just got is what we will use and the license will be valid for 1 year, correct?

All Canadian citizens will be issued an original or renewal driver license for one calendar year from the date of issue.
