Hey everyone! My petitions were approved Tuesday. I have been reviewing the timeframes from when we get our NOA2 to when NVC recieves our case. It have seen anywhere from over a month to 4 days but I think the average wait it probably a week. Anyone want to comment about this? Is there anyway to track our cases from USCIS to NVC?

Anyways, I've been putting together the papers that NVC will be asking me for. I am going with the I-130 petition...

IR-1/CR-1. Here is what I have come up with.

1. original or certified copy of applicant's birth certificate

2. translation of applicant's birth certificate if not in english

3. original or certified copy of marriage certificate

4. translation of marriage certificate if not in english

5. original police report (for Brasil...2 police reports are needed...one from federal police and one from state police)

6. translation of police reports if not in english

7. copy of applicant's passport

8. passport-style photo of applicant

9. DS-230 "Application for Immigrant Visa and Alien Registration" (Part I only?)

other forms and documents to be mailed by NVC or downloaded from web:

10. I-864 "Affidavit of Support"

11. DS-3032 "Choice of Address and Agent"

12. DS-2001 "Notification of Applicant(s) Readiness"

Am I missing anything? Also...I am guessing that the translations need to be originals also, correct? I was also reading under another thread that someone had their copy of passport notarized...is this necessary? Any input would be greatly appreciated.

Two quick comments.

First, look at Ling Ling's guide for good information on the process. You don't need to re-invent the wheel.

Second, regarding translations, you might not need them. Here is the sentence from the Department of State website "All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations. "

The key comment is "Or in the official language of the country in which application for a visa is being made".

Also, here is the comment from Ling Ling's guide "NOTE- if your interview is in the home country of the beneficiary, there is no need to translate supporting documents."

Something else I found on the State Department website that cut my eye had to do with making photocopies for them of all the original documents. Here is the text "In addition to sending the original documents or certified copies of the documents to the NVC, the applicant and each accompanying family member must submit a photocopy of the original documents or certified copies of the documents."

It seems they don't want to bother making copies. I don't mind if it helps speed up the process. But I don't think there is much talk about this extra copy here on VJ. I have seen some people doing it but I don't know that it appears on Ling Ling's guide or is common knowledge.

Timeline

Depending on the type of visa you are requesting...translation may or may not be required. My brother has started at the NVC back in April. If you plan on moving forward with the I-130 then understand that the NVC will collect the originals or certified copies of the documents needed and then forward them to the Consulate. Because the NVC is collecting the documents translations WILL be required if the documents are not in english. Again this in only if you are going for the same type of visa that I am...this does not apply to everyone.

I'm still confused about the translation issue. Or rather, I'm confused about why people think translations are necessary in most cases. The State Department website clearly states that translations are needed only for documents "not in English, or in the official language of the country in which application for a visa is being made." In the case of my wife, who will interview in Juarez, Mexico, I think this pretty clearly indicates that Spanish-language documents don't need to be translated. What am I missing?

I didn't want to risk an RFE so I sent the translations anyway.

We are also moving forward on the papers, and he will get things he needs to be getting with translations and i will start to do mine (more) and starting making the folders for evidences for him to take to interview.........dont risk anything its better to go ahead and send than to be held up while u go back and get the translations

Hi brnidokiegurl,

Yeah, I've been calling NVC too and they have no record of my case yet. Hopefully in a few more days it will get there.

I already have the translation of the marriage certificate, since I needed that for USCIS. The only thing I'd need to get is a translation of her birth certificate. (Police certificates aren't needed for visa applicants from Mexico.) So I guess I'll go ahead and get it done.

I will ask for all translations. Each country is unique. In the case of morocco, it's complicated. civil documents are in Arabic and partially in French. So to avoid any headache, I will just go ahead and translate them into English, just to minimize the chances of receivinh an RFE. Good luck to all.
