Thanks guys - I looked at the numbers and if I do an amended return as Married Filing Separately it will not affect my refund at all - Govi did not earn any income in his name for 2007. It is too much trouble at this point for him to get the IIN - I think if we were to file a joint return it would delay things considerably. I will call NVC tonight just to be sure but I think I will go ahead and file 1040X as Married Filing Separately.

If you file as married filing separately...they expect a return from your husband also.

You would amend the return to file as married jointly. His income will have no effect.

It will be the easiest $1500 additional refund that you will ever get.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

The problem with that is it is extremely difficult for him to get an ITIN in Kathmandu - if they expect a return from him even though he has never set foot on US soil and didn't earn a single rupee then I am screwed, really don't know what to do now - can't believe there is nobody else who has been in this same predicament. I don;t care about the money at this point, am dealing with cataract surgery on my one good eye at the same time as all this visa paperwork - I just want to get everything together so G can have his interview by late January at the latest.

I am more than a little frustrated - I have everything else for the I-864 ready to go except last year's tax return, was really hoping to have it all ready to go by the end of the weekend, one less thing weighing on my mind....

heres our case: i file married/joint as we had filed for the itn number along with the return (what we were told to do) ok they denied the number, for what reason we dont know so the return was held up. We send all the forms again, same story...so they now take it upon them selves to chg the status fr joint to seperate refund, send it to me end of story....same thing happen with the state since it also relates to the fed...if you marry within that year you have to show married...this next jan i will just go married/seperate again and not worry about his number until he hopefully gets here soon, they never ask for anything thing fr him except the papers to do the number

I called the IRS on this very question. Lengthy talk with a nice gentleman. You file a tax return as married. No SS# needed. In that space put "apply for ITIN now". Do not have to file amended return. (They don't like that ) Wasted time. You can do it for all dependents, regardless of where they live. And even some H and R Block didn't know that answer. It will take 6-8 weeks to get the ITIN, just like a SS #. Which they can not get without being in USA.

BUT THEY DO NOT GIVE ALL THE ITN NUMBER THAT EASILY many have been denied and we tried twice, our tax person did the first time she said same procedure she has done for others, it dont always work that way. Mine also went with the original filing of the tax and after a longggggggg delay they changed the report themselves and send me less return, the state doing same. It does appear to be easier to just go ahead file married but seperate and you can revise later. I didnt get the 600 like most did either, i was told i will get at this next filing since they changed me from joint to seperate qualifying me to get it
