Hi

I'm a British Citizen currently in the US with my fiance on a 90 day visa waiver. We have a K1 visa application currently being processed by the California Service Centre. I can see from the USCIS website that our case has been updated on 2nd October but nothing has happened since. No approval..nothing.

We are using a lawyer who isn't much help at chasing this up. On the lawyer's website we can see that other cases have been approved after 125 days. Ours is now running at 145 days. Could there be a problem? Would the USCIS let us know if there was?

This is really frustrating...any advice anybody?

5/16/08:Received NA01

2/24/09: NA02 APPROVAL... finally, after 9 MONTHS & 8 DAYS!!

5/5/09 : Interview Date APPROVED!!!!

5/8/09: visa received

From NA01 to interview: 12 LONG MONTHS!!

07/23/09: received SSN

08/17/09: Passed Driving test

08/22/09: Married on beautiful Mackinac Island, MI

AOS

08/31/09: Mailed AOS Package

10/20/09: Received AP

10/21/09 Received EAD card

12/7/09 AOS APPROVED!

12/14/09: Green Card arrived in mail. Happy Days!

It's taken 18 months from applying for K1 to receipt of Green Card! Thank God it's over until 12/7/11

Here we go again...

ROC

09/14/11: Mailed I-751 to Vermont

09/19/11: NA01

10/14/11: Biometrics

7/2/12: Approved. New Card Ordered

7/7/12: Green Card received

There is nothing that a lawyer can do to make USCIS process petitions any faster, USCIS indicates the oldest cases they are handling are from Feb 08. https://egov.uscis.gov/cris/jsps/Processtim...eviceCenter=CSC

You should fill in your timline and then it will give you a expected adjudication date

Also if you check on Igor's list you will be able to see what dates are currently being approved for VJ members so you can compare your dates

As YuAndDan said, your attorney has (so far as I know) no influence on the processing time for applications at USCIS.

Typically, USCIS will not even bother to take a detailed look into your case unless 6 months have passed. If it's under 6 months, they typically will just tell you to call back after 6 months have passed.

It seems from a cursory glance at your timeline and VJ's timeline tracker, you're pretty much at the current CSC average time for receiving your petition's results. Chances are your case is still just being processed.

USCIS would let you know if there's a problem. Typically, they'd send a Request for Evidence (RFE), detailing the information they'd need.

we filed the day before kevin and anna. finally got our approval, on the 23rd sept. so around the 145 days to 150 days mark. look at our timeline for an exact. well appart from the fact they didnt inform us of our approval and had it not been for nvc we wouldnt have known till packet three. when we phoned we were given the still within timeframe answer. i dont think we had a more difficult case than others who got processed quicker.and i dont think we will know what kept them so long or whats keeping them on other peoples.

You aren't even out of the average processing time yet. When you get to six months + then you can may want to start worrying.

Like others said, your lawyer has ABSOLUTELY no say in the process and no say in how quickly your petition gets approved, and if he claims that by using his services he can get you a visa faster, then you should punch him in the face because he's lying to you.

So in terms of you being worried, I wouldn't be yet. You've gotta practice patience, no matter how difficult it is.
