I-130 and I -485 concurrently

I have read on uscis.gov that one can file I-130 and I -485 concurrently. I am looking fore more info here. I am sure there are plenty of topics about it on this forum, I am just trying to find the right ones....

In which cases should I-130 be filed first? and when can i do it concurrently?

Most will do it concurrently... What is the current entry status of the alien?

If by K-Visa you do not need to file I-130 with I-485.

Oh, the links are just great !! Just what I needed! :yes:

I entered US as J-1 visa holder, the bad thing is that by now it is expired :unsure: , the good thing is I am not a subjet for -two -years residency requirement. So hopefully I will still be able to adjust my status based on marriage :unsure: .

I would really appreciate mor info on cases like mine.

You only need to pay the penalty if you meet ALL the conditions listed on form I-485A Pay particular attention to D.

1. You may apply for adjustment of status to that of LPR under section 245(i) if you:

A. Are physically present in the United States when the application is submitted; and

B. Have an immigrant visa number immediately available; and

C. Are admissible to the United States for permanent residence; and

D. Are the beneficiary of an approvable-when-filed visa petition, or an application for labor certification filed on or before April 30, 2001; and

E. Pay a $1,000 penalty fee (unless exempted).

Oh, really? That is great then, I thought that even though I entered with inspection( is it legally with visa in other words) but remained in the United States past the period of admission, I still have to fill this supplement A and pay 1000 penalty.

If not, that makes things easier (cheaper :thumbs: )

Hello, hope this is an appropriate place to ask this - it is related to the I-130 form:

In box 22: "Your relative is in the US and will apply for AOS to that of a lawful permanent resident at the USCIS office in:"

As I will be filing the I-130, I-485 concurrently - do I simply put:

City: Chicago

State: IL

As that is where the form instructions tell me to send these forms?

Just checking that I don't put "Jacksonville FL" - just because they're near to me... do I?

Living together since Sept 07

Getting Married Dec 24th 08

Hoping to file for AOS + Work Auth thereafter

oh, i thought the local office was meant here, i am not sure though :unsure: , so that is my question too.
