:unsure: Hi everyone. Im confuse as how K3 works. I talked to a K3 applicant during my medical interview and she said that she and her husband is on K3 route but is also processing the I-130 for the CR-1/IR-1. Since she already have interview date for K3 route, is it correct to pursue CR-1/IR-1 even if she is on the K3 route? What I understood is that if you take K3 route and has been admitted in the US for th K3 visa then next step will be Adjustment of Status. What I understand is that we no longer process I-130 because as I have K3 visa and will abandon I-130 process... Is this correct?

This has made me confused today :wacko: My husband has received notice from NVC regarding our I-130 and advised my husband to pay $70 for the Affidavit of Support review fee. But since we are on the K3 route, we ignored that notice. Should we still process the I-130 even if I already have schedule for interview? Please I need your advice. Thanks...

Hello, I just look at your timeline and found, that both the petitions have been approved in the same day. I would pursue the I-130 instead of K-3, because when your husband/wife comes to the country, he/she will have the conditional residence green card for 2 years and all the privilegies as employment, SS card. You do not need to adjust the status and pay extra 1000$. If both the petitions are approved in the same time, you can pick the one and another will be stopped automatically.

You can still pursue the CR1 visa if the NVC is processing the I-130 as such. One way to do it is to follow the shorcuts found in the NVC forum so you can be done with the NVC in about a month or so. Meanwhile delay the K3 visa interview.

Also, if you don't follow the shortcuts, it can take the NVC up to 3-4 months to process the I-130.

If you've already done the medical and your k3 interview is less than 2 weeks away, that doesn't give much time to process the I-130 through NVC, which can only be done if the I-130 paperwork was sent from USCIS to NVC.

NVC processing takes at least about a month if you follow all of the shortcuts diligently without making mistakes on any of the forms, after which it takes maybe 2 weeks for NVC to forward it to the embassy (even if they agree to an expedite request).

If you really want a CR visa and not k3, then you should first check to see whether the I-130 was forwarded to NVC and then postpone the k3 interview by 6 to 8 weeks to give time for the NVC processing, but it will be a close call.

My question is, do we have to process I-130 even if I would have my interview on the 29th and might come over to US with a K3 visa? Do we need to pay anything for I-130? When I get to US, should we still process I-130 or process Adjustment of Status? Which is which? The lady I spoke with said she will go to US with a K3 visa but they are also processing I-130 now and until she comes to US.... Im a bit confused about that... Thanks :)

If you are following the K3 visa, and if you obtain the K3 visa, you no longer need to continue the process for the I-130 at NVC. Once you arrive to the US, you process AOS.

If you are following the K3 visa, and if you obtain the K3 visa, you no longer need to continue the process for the I-130 at NVC. Once you arrive to the US, you process AOS.

Thanks YGandMAT :) I saw you chose the K3 route and been approved for the green card. Your answer made me feel relieved. I will continue to ignore letter from NVC for I-130 because I will come to US with a K3 visa and will process Adjustment of Status when I get there... Thanks so much and God bless you :)
