Let me first try to explain the situation..

We recently filed for AOS after marrying on a K1 visa

I met my husband (dual national USC/belgian) while he was working in Belgium.

Since being both belgian citizen and USC he filed taxes in Belgium and in the US for 2007 for the year he worked in Belgium.

We got an RFE for the I 864 because of missing w2 files....but we don`t have those since that is a form used in the US.

W have something similar, but does anybody know if they accept these forms?

I don`t see how anybody would be able to compare or use these forms, but if that`s what makes them happy...

I would appreciate the help or some advice of somebody who has been in the same situation..

Nobody who`s partner used to work for a foreign company abroad and doesn`t have a w2 for that year?

Request an IRS transcript... According to the instructions for I-864 IRS transcripts can be used in lieu of W2s, 1040s, etc..

Ok, similar situation here. My husband and I worked in the UK during 2007 and filed a joint tax return in the US. Initially we sent IRS transcripts for 2007 with the I-864 to support the income my husband wrote in the Affidavit of Support. However, this was not enough. We received an RFE for W-2's. Obviously we did not have that, so we sent the British equivalents of W-2's plus a year's worth of British paychecks. We explained in a cover letter how we calculated the income on I-864 based in the "British W-2's", including the exchange rate. This worked for them. So IMO, if you have the Belgian equivalents of W-2's, go ahead and send copies together with the IRS transcripts, and explain in an attachment to the I-864 how income was calculated in dollars.

Sometimes it makes me mad how these people at USCIS just follow their strict guides and don`t even take a minute to look

at the details of each case...hup..RFE in the mail and another delay of a couple of weeks!

I was in a similar situation. However I got a 2nd RFE for the same thing after submitting the "w2" equivalent from the country I worked in.

No worries now. Once I sent in the response for the 2nd RFE we got transfered to CSC and then we were approved within weeks. My husband has had his greencard since July. It's all a distant memory now, thank goodness.

Hope everything goes smoothly for you from now on :)
