Sorry this question has probably been asked/answered time & time again but i've got that stressed trying to find it!

Rob has a job, although he changed jobs recently, and he earns over the stated poverty figure + 25%. However he didn't file taxes last year for personnal reasons...

I did have an Uncle willing to co-sponsor but was told last night that he is withdrawing his offer of support, as he's just filed bankrupcy. I am trying to get hold of other relatives I have in US that may be willing to help but it's looking doubtful.

Is it going to cause a major problem if at interview I have the Affidavit of support from Rob along with employer letter & wage slips but no tax info?

I think i've seen somewhere that going through London they may be willing to self certify a certain amount?? I can show deeds to a house i own in NC and information on my Forces disability pensions that i receive monthly.

With all this in mind am i still best trying to get a co-sponsor?? Other alternative is trying to get his taxes filed late and paying whatever penalties they decide?

Not filing for personal reasons doesn't cut it. If he made that much, he should have filed. I would say go with filing late and see what penalties they assign if you can't find a co-sponsor.

remember too that K-1 support is only 100% of poverty level - it's the AOS that's 125%.

Even thought the uncle is filing bankruptcy, he can still be a co-sponsor. They only look at copies of tax returns and the employer letter, so they'll never even know about the bankruptcy. Plus, the affidavit of support at the embassy level is non-binding, so by the time you file AOS next year, your then husband's income should be sufficient to sponsor you.

Personal reasons for not filing taxes is not going to work forever, either. I suggest he files late and takes his lumps. It will be better for you in the end.

On the plus side I have a cousin who is willing to do the affidavit of support for me,so if he can't get his taxes sorted in time it won't hold us up!

That's good to hear. I didn't file my tax return initially because I had no income (I'm a student), but I realized it was better to send in something that said 0.00 income than nothing at all. Hope things get sorted out and you're not delayed any.

If you are in a refund status, then filing a tax return late will not hurt you... in fact the IRS will pay you interest on your refund money.
