while i wait for the USCIS to figure out what they are doing with the new act i am second guessing myself about the poverty leval..ok so here is the deal...in the tax returns for 2003 and 2004 i was over the poverty line...the family i worked for moved so i was out of a job in 2005 from about jan. to august moved back with my parents and then end of august got a new nanny job so my income from august to january was not that great and way under the poverty line... so when my fiance and i eventually go to our interview does anyone think i will have a problem??? i have a letter from my boss saying how much i make which is over the poverty line...i just want to make sure that i don't need to go looking for a sponser....

thanks

The thing is: if you didn't make the minnimun income during all the year, yes...

So, you'd better go find a sponsor... Or else they would probably reeschedule your interview AGAIN for you to have avaiable time to find one!

Good luck!

Priscila and Christopher-

No offense meant to you but I think you should be really careful when giving advice to make sure that you have your facts correct. Especially when someone is asking a questions that can be so critical to their application. Unfortunately, your response is not completely accurate.

Nanygirl......please see the quote below from another post regarding a similar question:

"Affidavits of Support are adjudicated with the most weight on *current income*. If the OP is earning sufficient income at her new job, the CO must take that into account. They must also take into account *why* the petitioner's income was insufficient before.

You can search this group: http://britishexpats.com/forum/forumdisplay.php?f=35 for posts from Folinskyinla, an immigration attorney who posts there. He has cited examples................."

There are no guarantees. Gather what you can from others' experiences, but keep in mind that you will be safer with a cosponsor. The CO would be within his rights to approve your fiance's visa based on your current salary. He would also be within his rights to deny it based on your salary history.

nannygirl,

If it's difficult to find nanny jobs then I don't think you want to offer that fact up unless the question is specifically asked. The specific question being, "Is it difficult to find nanny jobs?"

Two significant issues are, what is your current income and is that income sustainable. Don't deliberately plant the idea that it may not be sustainable.

Yodrak

thanks....i think if i go and explain my situation....that is is hard to get another nanny...not as easy as everyone thinks it is...then i think they should be ok with it....
