I have a coworker that married a guy from Scotland well last August he received his Permanent Resident card and they have to go back in 2 years to have the conditions removed Well she is having second thoughts about the marriage. If she divorces him before the two years are up what will happen

to him

As soon as divorce is final he would be able to file I-751 with waiver of the Joint filing requirement, he will need to demonstrate and provide evidence that the marriage was entered into in good faith.

Note this should be in the Removal of conditions forum

In other words, he can still get his 10 yr greencard and be an unconditional permanent resident if he proves that he entered into the marriage in good faith.

Does she want to prevent him from removing conditions out of spite?

That's what I am thinking.........the spite thing.........Otherwise, why do people put such emphasize on the timing of the green card and divorce? If divorce is in the cards, just do it. No need to look at some sort of timing.

Life's just a crazy ride on a run away train

You can't go back for what you've missed

So make it count, hold on tight find a way to make it right

You only get one trip

So make it good, make it last 'cause it all flies by so fast

You only get one trip
