I want to say sorry for all of the questions but any help is appreciated - We got new news today that has been updated from before. Basically, my dad has been given 4 weeks to live and I want my new born baby to see my father before dieing! I have asked in other threads and I understand the risk.

My situation is we submitted I-130 visa April and have not gotten our 2nd touch yet.

If my wife comes to America - I need to show proof to return home - I understand this.

But what are the consequences if she is denied entry at the port? What will happen at that time?

My big concerns however are:

1)

IF she is denied entry into the United States WILL this effect her Visa application?

2)

If she is denied entry - am I responcibile for paying the return flight ticket. Do I have to go to the airport and spend $4,000 for a same day international flight ticket or would they just transfer her roundtrip ticket (Oct 18 - Dec 20) and adjust to to be Arrive Oct 18 and Depart Oct 18?

All of your help and concern is very appreciated - this news has been very shocking and has us all surprised. All I want is for my dad to see his grand daughter before dieing but do not want to risk paying $4,000-5,000 for a same day international ticket as well as effect my wife's request for a VISA and then have that denied next year in our interview...money aside, a denied VISA is not worth the risk of bringing her here now.

Thank-you everyone again. I am sorry to flood the board with my messages but I am trying to gather all the information as possible and need to buy a ticket by Sunday night if my wife is to come on time.

Our circumstances were a little different, but my wife applied for a tourist visa at the American Embassy in Belgrade, Serbia in November of 2006 and was denied. We filed her I-130 in October of 2007, her interview for her CR-1 visa was September 30, 2008 and she received her visa on October 4th, 2008. In our case the denial of the tourist visa did not influence her CR-1 visa. The denial was also almost 2 years ago. Hope this helps! Good luck to you!

Thank-you so much for the replys. Everyone has been a big help.

I think my plan will be to bring her on Tuesday of next week.

Can anyone help me think of an idea of how to proove that my wife will go back to Japan? She is a stay at home home, no job, no rent (she lives at home with parrents). The only thing I can think of is that I must proove that I will not enable her to stay here (for her to stay here would require that I enable her to do so).

If anyone has an idea to add to the list I would greatly appreciate it - so far, my list is as is below.

My proof to show reason to return is:

1) Letter from Dr. stating father will die in weeks or less

2) Letter from General Manager or above at work stating that I will be making many business trips to Japan as well as working in Japan for 1.5 years starting in 2010 (hopefully this will show that we have no reason to migrate to the States illegally as I will frequently travel to Japan and even live there.

3) My ticket to Japan - Wife and I will both travel to Japan together at Christmas time, so we have basically two return tickets to show.

4) Letter from Priest showing we will do a baptizim ceremony in Japan at Christmas

5) Hotel reservations in Japan and travel plans for us during christmas break

6) Bring Father to the Airport (one look at him and it is clear he is dieing)

I think what you have is good. I got a list once of suggested ties to home country. Things they suggested I have are:

1) bank account in home country with 'substantial' funds

2) work or educational ties to home country

3) lease or mortgage receipts

4) utility bills (even credit card bills)

I am not sure your father will be helpful at the airport for 2 reasons, won't she clear customs before she sees you (coming from Canada we actually clear customs in CANADA, not the US and US POE's usually don't allow visitors back there) and also the customs agent may say if your father is well enough to travel that he isn't THAT sick, even though he is. I"m only concerned that if your father doesn't have to make trip, maybe he won't.

If your wife is well prepared she won't have any problems. I suspect she'll be fine! Good luck.
