I am planning on starting the K-1 process in February, after visiting my fiance in Cuba one more time. I am also planning on moving right when I return from that visit. Right now I am in Florida, planning to move to New Orleans, Louisiana. I am planning on starting the K-1 once in New Orleans.

To explain my situation a little better, I am originally from Michigan but I had been out of the country for about a year, and upon return landed in Florida, where I have been for the past 3 months. I would like to stay here until February, go to Cuba for a visit, then move to New Orleans upon return, then start the K-1 there.

My question is, Does it matter in what state I apply for the K-1? Do I have to be living somewhere for a certain amount of time? Do I have to do it in my home state? My logic tells me that I just have to be residing in the state that I apply in during the process, that it doesn't matter where or when.

The other thing I was thinking about was the affidavit of support part, when I give proof of work and pay, I wouldn't have been living anywhere in the country for an entire fiscal year by the time I apply anyway, since I was out of the country (and not really working for pay, only volunteer work). And either way, I don't make above the "poverty line", so I am going to find a co-sponsor. Do I have to worry about work and residence in the past year?

I'm just worried that moving could either make us not qualify, or even just look bad on the application. Do I have to worry about this?

You do not need to be is a set location when you file.

HOWEVER, I would use an address like a parent's address for the mail, you DO NOT want to have something like I-129F NOA2 letter LOST in the mail, the post office will lot forward mail sent by USCIS, they will return the mail to USCIS.

You do not need to be is a set location when you file.

HOWEVER, I would use an address like a parent's address for the mail, you DO NOT want to have something like I-129F NOA2 letter LOST in the mail, the post office will lot forward mail sent by USCIS, they will return the mail to USCIS.

Normally the NVC will send you a letter asking for an agent which happened in my case. Just simply indicate an agent which can be a relative or a lawyer and your new address. This case all documents will be mailed through these two addresses.

And if asked for an agent, I can give the address of a relative (not a friend?)? So if I decide to file in Louisiana, I could theoretically use the address of my mother's house in Michigan on the application? Would I still need to give my address in Louisiana? And there should be no problems wherever I file, as long as I have a set address? I just want to be clear, because I am basing my decision to move on this process going smoothly.

You need to file with whatever center handles the state you are using for your mailing address on the petition. Here is a current list.

Even though they have a change of address form, as Yu and Dan stated, I would not trust any changes made. You need to use an address you know will stay consistent as you will need your NOA2 hardcopy and any relevant documents (rfe) throughout the remainder of the process.

So, please tell me if I have this right. It does NOT matter where I live during the process. I just need to file in whatever state my mailing address is in. So if I use a constant mailing address like my mother's, and she lives in Michigan, I would have to file in Michigan. Even though I live in Florida and will be living in Louisiana, I can use my mother's address and file in Michigan? This means I cannot use my mom's address and file in Louisiana? This also means that if I file in Louisiana I should make sure to have a fixed address in Louisiana throughout the process?

It tells me that if I LIVE in Michigan it goes to California, and if I LIVE in Louisiana it goes to Vermont. If I want to use my mother's Michigan address as a stable mailing address, should I file in California or Vermont, if I will be living in Louisiana? Do they go more by the address where I reside or the mailing address??
