Hi all,

My husband lived undocumented in Italy for about 2 yrs. We left, his passport was stamped, and he is now in his home country. He has never committed any crime. He received his police clearance for his home country, but when he had his brother go to the office in Italy to request any kind of clearance (even though he is of course not in the system), they told him that they couldn't give him anything, because there was nothing in the system, and no record of my husband (obviously). His brother tried two places. He's going to try again, but I'm freaking out, because this is a requirement, and I'm not sure what to do. Do you think the Italian consulate in Albania would be more helpful? If his brother just can't get anything, any thoughts on what we can do, or what to expect?

Any advice or similar experiences??

Here when we send people to get record checks (i work for government agency) to up date their arrest record the(local city county) agency will look if they find nothing they usually give a paper that says persons arrest records were check between X time to x time and no records were found, guess thats not really telling you anything new but cant they just issue the same type statement

You would think they would just issue the same type of statement, I'm just getting the impression they don't want to. I'm not sure how well his brother is explaining the situation, but it seems to be really straight forward. They should just be able to run his name with dates, and generate a report that says nothing. Done. Simple. Perhaps if he went and didn't say that he was undocumented, maybe they would run for him- they might just not want to help because he was undocumented.

The undocumented part may be an issue.

NVC will want a report.

Police Records

Available. The Certificado Generale del Casellario Giudiziale is a certified record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).

Persons within Italy can obtain the certificate by applying in person or by mail at any office of the Procura della Repubblica. Such offices are located in all major cities and in many small cities and large towns. Those who apply in person must submit a written request, a photocopy of a photo i.d., and all fees; the certificate is usually provided the day of the request.

Persons outside of Italy can obtain the certificate by writing to:

Ufficio del Casellario Giudiziale della Procura della Repubblica,

Piazzale Clodio,

00100 Rome, Italy

Those requesting the certificate by mail, whether from within or outside Italy, must submit a written request, a photocopy of a photo i.d., and all fees, along with a stamped, self-addressed envelope. Ordering it this way may simply get a notice of NO Record Found, which may be adequate.

He was un-documented. He has never registered himself with authority and how do you expect them to write that your husband even was existed?

As you said, you should or he should contact Italian Consulate in your or his city and ask them for more help.

When I was going to get my wife's from Turkey, I sent docs to Turkish Consulate in Los Angeles but they are yet to process it after two months now. I had to pay a lawyer to do it for us in one week. (Lawyer was in Turkey) but if you said that your Husband's Brother is in Italy, ask him to contact hem again and see anything comes out of this.

Thanks for all your help. I emailed the Procura with questions. He was working in Italy, and living with his family, who are all legal in Italy. Oh... I don't expect anything to say that he even existed. I just expect a report to say that there is nothing in the system, as there isn't.

His family lives in Florence and his sister went down to the police station to ask about the form and they said it would only take a day when needed. Your husband NEVER registered with the police? Even though my husband's visa was only for a few months, he had to registrar...he just didn't leave when he said he would. I had to registrar to live in Italy (at the post office) for six months but I left before my police interview date. They let me live, work, and study in the country for six months without an interview.

His brother will know if he NEVER registered or just never turned up for the 2nd police meeting and worked on a "false" visa i.e. a visa for a medical visit or tourist visa.

Oh shady Albanians...

He never had a visa for italy, so there's absolutely nothing in their system (except for his passport stamp I'm sure when we left). He spoke with a lawyer in albania, and my husband sent the request letter to his brother, who is going next week to get the certificate. So... did your husband then get the certificate? Any problems? Any problems with american consulate because of it?

Suggestion, maybe the procura can establish an "adhoc" document saying they have no record of him.

Feb 3 2010 update card ordered says to allow for 30 days

Feb 8 2010 update saying approval notice sent

Feb 12 2010 received GC card Permanent resident valid till 2020

Feb 18 2010 went to file ss5 for ssn card as not yet received and center would not find me in ssn files
