Hello everyone!

Im really in a tough situation right now. I got married in less than 3 months and we decided that it would be better for me to go back to Philippines. We just don’t get along and it has been this way…pretty obvious that we cant do anything about this now. Husband is freaking out….wants me to get the ticket to day and ship me out tomorrow if possible. I haven’t filed for adjustment of status yet and I would to clear this marriage before going back to Philippines if still possible?! What should I do? I know I need a legal advice but its just terrible because I don’t have time left for this and Im totally dependent on him … what would happen to me? To this marriage? Is it possible for him to work on getting a divorce or annulment by his self and with me being in Philippines?

Yes it is all possible.. Why insist go home start a new life. I don't care what people say back home it's your life you deserve to be happy. If staying here with your husband is like a hell GO HOME, that's the advice I can give you.

its better for u to go back in the philippines. who knows whats going to happend next. if ur living like hell now. better leave as soon as possible. he might hurt u physically in the end who knows . goodluck

i cant see any reason why would you choose to stay with your freak husband (im sorry). dont wait till he gets to hurt you physically. don't mind what people say about you comin back to philippines coz your life is much more important than what they say against you.

Sorry to hear about your bad luck and I would agree with the others. You should go home to the Philippines as soon as you can and be happy and not live in hell. It is a shame after only three months it is this way for you. Take care and God bless

RIGHT! Im going home...I want to go home but I would like to know if it is possible for him to clear out our marriage even without my presence in States? What does it take to get a divorce or annulment? Do I have to hire my own lawyer? Its really hard for me to do something because Im totally dependent on him. PLSSS give me an advice on what to do. hi. i'm not a lawyer but from what i've read, you don't need to be here in the us to facilitate a divorce. your husband does need your signature on the divorce paper, which he can easily send to you thru mail. and no, you don't need a lawyer for that, unless of course you're seeking a recompense of some sort.

i don't think an annulment is an option for you, since, i would assume, the marriage was consummated and was entered into in good faith.

i'm sorry about your situation.

I don't know the law, but my older brothers wife came over on a K-3 and they applied for AOS 2 years later and she got it. His excuse was he was clueless.

everything has purpose god has good plan for our life but i understand its hurt but just remember you have

real man that loving you in a right time and make you more stronger woman and help you a better person

I don't know the law, but my older brothers wife came over on a K-3 and they applied for AOS 2 years later and she got it. His excuse was he was clueless.

K3 is a 2 year multiple entry visa. K1 is a one time entry and expires in 90 days from entry.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Hi Huggykiss,

I'm sorry to hear about your situation. Did you try to go to your local court house and ask for a legal advice? (From a district Attorney/Lawyer?) It's possible that your husband will file for a divorce and would probably send a divorce papers for you to sign. You'll need to keep a copy of the final decree of divorce coz you might need it in the future. (You may start your life all over and get married again in 5 or 10 years). Then you must keep legal documents.

Go home as soon as possible!

Sorry to hear that your marriage didn't work out. It's better to seek a happy life somewhere else if your relationship with your husband is not good. It's better to go back to the Philippines where you have family and friends who can help and support you emotionally than in the States where you are fully dependent with your husband and no one else to turn to except probably here at VJ.

As for the divorce, if both of you are willing to divorce and uncontested, no assets to divide, no children custodies, etc....both of you can go to a Paralegal Service and their fees are a lot cheaper than a lawyer if you don't want the hassle of going to the court. I'm not a lawyer or work for a law firm, but in my divorce experience, I used the services of a Paralegal and we didn't go to court. My divorce was easy and I didn't have any problems. It only took long because he is out of the country and lives in a US territory. We were separated 2yrs before I filed for divorce. I was just procrastinating. Anyway, the total fees I paid was about $700.00 and that includes the Paralegal's fee and court fees. I assume your not working yet, so you can probably have your husband pay for the fees. At the Paralegal office, on your first consultation, they will explain their services to both of you and if you accept they will ask general questions such as assets, children, etc... in putting together your divorce papers and if you accept their services, you would pay half of the fee. Once they have completed preparing the papers, usually takes only a few days, you would take those papers and have it notarized. Then you would take those notarized papers back to Paralegal Service, pay the rest of the fees and they will do all the legwork for you.......going to court and have it signed by the Judge. You don't have to go to court and see the Judge. Once signed by the Judge, your free and divorced. Usually takes less than a month, maybe even just two weeks. You will get a copy of the divorce decree from the Paralegal Service Office. To get a certified copy of the divorce decree, you need to go to the court records. Oh, before you get a copy, you will need to go to a divorce class.

I hope in my divorce experience, it will help you in some way in your own divorce. I don't know if this process is the same in other states. I reside and filed my divorce here in Las Vegas. In my opinion, get divorced first before going to the Philippines so you have a certified copy in your hands and your free again and don't have to worry if your husband has already filed for the divorce or not especially if your already in the Philippines and also before your visa expires. If it's true that you have 180 days, then look for a Paralegal Service so you can process your divorce right away.
