I usually never submit these HELP!!! Topics so I apologize in advance for doing so but I do need help.

My father will be dead in 2 months according to Dr. and I want my wife and new baby to see him before he dies.

Can she come to the USA to visit for 2 months?

Our status:

Submitted I-130 in April - waiting for 2nd touch.

I plan to go back to Japan with her in December on same flight - so I can proove reason to return to country.

I also have a hand written note from the Dr. stating the circumstances.

Does anyone know if with all of this immigration will allow her in while we are waiting for her visa or will immigration likely make her and the baby go back to Japan?

I need peoples input because I want to buy her airplane ticket as soon as possible!

They might allow her in, especially if she can show strng ties to Japan still; does she have a job to go back to, a home owned etc? Bring lots of proof that she'll go back.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

She has no job, she is just stay at home mother. The only proof we have is that i am going back with her in December on her return flight (I already have a ticket purchased to return to Japan at the same time she does)

sorry to hear your sad situation.

she can enter the country on a visitor visa, but as other suggested she will have to bring in proof of strong ties to Japan and will have to convnice them that she has intentions of returning back to Japan to complete her CR1/IR1 process. have her bring copies of lease for the apartment or mortgage payment for the house. have her buy a return ticket to japan.

Hi there,

I visited my husband while waiting for our application to be approved. He came to Malaysia for a visit and we flew back to LA together. Not many questions asked. The POE officer didn't even asked for my return ticket nor proof that ties me back with Malaysia.

Perhaps it would be easier if you were to fly with your wife to USA.

Just be calm and confident with your answer.

11/12/08- Received SSN in mail!

11/20/08- Got my WA driving license!

I-751

08/03/10- I-751 sent

08/09/10- NOA

08/24/10- Biometrics

10/28/10- Case approved

My condolences to your family.

Regarding your situation,

anything is possible, nothing guaranteed.

As others have stated,

1. Since she's a citizen of Japan, she can enter on the Visa Waiver Program

a. She should have a return ticket.

b. It's good if she can prove ties to Japan

2. She can still be denied entry.

a. She can be denied because she's an immigration risk (young Japanese woman and child, married to USC)

b. She can be denied because the immigration officer had a bad day.

An expedite request to USCIS will most likely take longer than your situation requires, and there have been many recent situations similar

that were denied the expedition request.

There are risks involved, and only you can assess them.

I apologize for all of the questions without much research...I will try to do that tonight after everyone leaves our home. Now, all of the family is here trying to spend our time together with my father.

I think that you are right, it depends on the mood of the immigration officer. Basically, because we have applied for a Visa then it shows that my wife and child have intent to stay in America with no intention of returning home to Japan.

To counter this I need to bring proof that in fact, she has plans that are dependent on her returning to Japan (not merely a return ticket as that is only a financial matter, but something dependent on returning...showing vacation plans for us over christmas break or showing reservations at hotels in Japan for her and I or something of that matter).

My big concerns however are:

1)

IF she is denied entry into the United States WILL this effect her Visa application?

2)

If she is denied entry - am I responcibile for paying the return flight ticket. Do I have to go to the airport and spend $4,000 for a same day international flight ticket or would they just transfer her roundtrip ticket (Oct 18 - Dec 20) and adjust to to be Arrive Oct 18 and Depart Oct 18?

All of your help and concern is very appreciated - this news has been very shocking and has us all surprised. All I want is for my dad to see his grand daughter before dieing but do not want to risk paying $4,000-5,000 for a same day international ticket as well as effect my wife's request for a VISA and then have that denied next year in our interview...money aside, a denied VISA is not worth the risk of bringing her here now.
