This question gets asked so often on these forums, that I think it would be helpful to get a better idea of the actual number and the "success rate" of people who have been able to enter the USA and visit their spouse or loved(legally of course:) during the immigration process.

My wife has been here twice, both times with very few questions asked at the POE.

Its less stresfull than some people make out, usually those who never tried it.

Aug 31st Congratulations letter, no interview needed
Sept 21st 2009. New green card with conditions removed arrived.

07/26/10 N400 mailed via UPS. Three year rule
08/03/10. Check cashed.
08/06/10 NOA letter received, but "Request for evidence" showing on the status website.
08/08/10 NOA #2. Biometrics appointment letter. Scheduled for 08/31/10
08/09/10 Biometrics completed. Walk in.
11/01/10 Touched. Transferred to local (Tampa) office
12/06/10 Interview . Passed
01/11/11 Oath ceremony

I have a pending I-130 at csc, but the embassy in the uk have allowed me a 6 month tourist visa to travel to us with our newborn to see my husbands family, I have employment contract, lease agreement, letter from employer, proof the my husband lives in UK with me his, job contract and payslip. I did overstay my previous vwp cause of illness and have proof of illness. I am entering in orlando on 30th May. What do you think???????????

You will be fine! You´ve got a tourist visa like me.

Plus, your husband is not in the US.

Only show the proof if the immigration office asks you ok? That´s what i will do.

Lets wish good luck for each other, i will be traveling tomorrow.

Good luck to both of you!

I'm glad I ran across this topic, because we are planning on P visiting me after we file the petition. I am wondering, will it matter if he's here visiting when I file the K1 application? I mean, he'll have a return ticket and have a date for registering his thesis at the uni, so I think if there were any problems, he'd be able to show proof.

My trip went out jUST FINE!!!!

I had no problems at all at the immigration!

The only ting the Officer asked to see was my tickets back to Brazil.

Thank God He kept me calm.

Now I am back to Brazil to wait for my K1...

Good luck for who is trying to see your SO, There´s no need to worry like me! The immigration doesn´t have any link with the Visa´s department.

But be sure to bring as many proof you have always!

Lai had a business visa, so had no trouble coming here before we filed. She visited me four months after my first trip to see her in HK, and I file the petition after she left. Even though she had the business visa, we didn't want to risk her being turned back at the POE if she tried visiting...we couldn't have afforded it if her trip was wasted.

I got through just fine at YVR. Brought enough evidence to prove my ties to Canada, and most of it wasn't necessary - the border official asked to see my return ticket, and asked a few questions. That was that!

I entered the US on the 4th of June 2007 without any problems. They only asked me the reason of my visit, I replied tourism and seeing my wife. I vouluntarely told them that we filed in February. Then he asked me what I do and I said where I work (a research institute) and what I study (for a master's degree in economics). Lastly they where interrested if I'm trying to bring any fresh fruit, seeds or insects to the US. I replied no, and that was it.

Just to be sure I had with me a note from my work, a note from my university, a note from my landlord, bank statements, and multiple notes from various companies with whome I've done an enforcing agreement with (like internet connection, insurance, credit card info etc.). None of those where necessary, since they didn't ask for any proof.

Visiting the US after filing seems rather easy, but its best to bring as much proof as possible. Some do get denided entry. Good luck to all who are planning on visiting your SO in the US :thumbs:.
