hey i have met my Fiance+wife in 2001 through internet. we filed i-130 in 2003 denied after two years of waiting. we have daughter togather. so filed k-1 visa march 01st 2006 approoved may 23rd 2006 took 85 days to process what are the chances for us?

Meeting Online: Yahoo chartroom Aug 2001.

Direct meeting & marriage: Dec 2003 USA, NY

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

A little confused. Is she your fiance still or now your wife? An I-129F for a fiance cannot be filed if you are already married. K-1 visas are for fiances only. I am curious why you filed the I-130 back in 2003. Which visa was it for? Did they give you the reasons for denial? Too many details missing in order to tell you if you are on the right track or if you need a consultation with an immigration lawyer.

As Lorelle said, it's unclear.

From your timeline, you have the NOA2 meaning the VSC approved your petition and I'd imply you are not married, not married "legally" in any country.

If you are married legally in ANY country in the world, Lorelle's suggestion of the immigration lawyer is where I'd go post haste. K-1 is for couples who are not already married to each other and are not married at all to anyone and are free to marry.

good questions!!!!!!!! ok things start from Dec 2003 when I went to USA to meet my honey lori. We married in NY USA. I came back to Japan. tried to wisit her again in Jan 2004 but i was denied entry bcz of I-90 violation. Lori came to Japan and we filed I-130 in the DCF procedure. Case reffered to DHS Korea after intervied in US consulate Tokyo ( they thought us SCAM couple) so lori went back to USA she visited three times in 2004 to Jap but case was still pending. she left USA and migrated to Japan to be with me in macr 2005, we blessed with daughter, delvered in japan. still case pending. finaly july 2005 got answer from DHS korea marriage not valid bcz Lori's previous divorce not valid. ironic isnt it? after two years they noticed that her divorce isnt valid?lolollol.. anyway we were living alredy togather in japan so we filed her divorce in NY state. granted from NY supreme court in Nov 2005. So we then filed k-1 visa i mean me and lori.

Ok.......this is getting more complicated. By what you are saying you did marry but the previous divorce wasnt valid.....(I presume) making the marriage void???? The divorce is now legal so you have filed for K-1???? Seriously darlin', have you gotten legal advice on all this lol dammmmm. If not I would seriously think about it so there isnt any complications come the interview.

I think you need a lawyer for this case, as it's clearly a more complicated case than we're used to seeing and thus we have no experience whatosever in this case and since we're not attorneys, well, you should seek legal council.

ok first of about divorce and marriage. lori filed divorced against her hubby but through the mexican court. it was granted so on the basis of that divorce she though to be free to remarry. we got married in NY as her city office accepted that divorce. we were legaly married but when we filed for i-130 the case was denied bcz fedral law doesnt approve mexican divorce. so it was bigamist thing. now as she has got divorce from NY so she is free to marry legaly. well as for as lawyers are concerned till now we have paid 10,000$ in total between all this procedure.

Hey Honey,

Your case is very complicated, think about. How do you expect US immigration to understand, when we can't. Immigration are too impatient and not legal savvy for them to follow a divorce from Mexico all the way to japan. what i mean is, may be you should find a good lawyer and work with him instead of paying foy some crooked lawyers. All the best. :unsure:

well what happened was the first divorce she did was by"proxy"meaning she gave power of attorney to represent her in the court of mexico since she couldnt travel there at the time,it was that ..that immigration would not accept. they said she had to be there herself in person in order for it to be valid. thats when we hired another divorce lawyer(who was not at all crooked) he was great actually,expensive but great, and very professional. after that divorce was finalised we decided to hire the immigration lawyer...look at any immigration lawyer and they are all expensive, anyway long story short, we are now free to marry and filed the fiance visa with a lawyer backing us up so that no stone is left unturned and no flaws are made available for another denial.

On a simple level - You were not considered really married because she was not considered 'properly' divorced and now everything is 'settled'. Then you should be free to pursue the K1 as long as the USCIS understands that and you dshould get the visa. I as others, feel for you and wish you the best. Go for it and see what happens - I think you are OK now.
