MY father is going to die in 2 months and my wife is coming to Visit and bring our newly born baby (1 month old) to see my father before he dies.

My concern is we are waiting for her Visa...we submitted I130 in April and are waiting for the 2nd touch.

I know during the waiting time you are not supposed to visit America but would this be okay?

We have a hand written note from the Doctor explaining the circumstance as well as we plan on returning to Japan together (She has a return ticket and I have a ticket to visit Japan for Christmas break)

Does anyone see this as a problem or do you think immigration will be considerate and let her enter the states?

I hope they give you an exception, but there is another member whose father was dying in the US and they wanted their spouse to meet the father before he passed. Unfortunately the visa was denied and the spouse didn't get the visa before the father died (God rest his soul). Yet it cannot hurt for you to try as you never know what the mood of US immigration will be.

Is this true? Her visa has not been denied...we are just in the waiting phase.

Is this still a problem? I can understand if her visa was denied but during the waiting phase she is not supposed to come to America but it is not illegal.

If this is a problem, the only way for my father to see his grandchild before dieing is to go to Japan!?
