Going to the US before the K1 is finished

Hi everyone,

Is it possible for me to go to the USA for a visit while the K1 process is running ?

04-30-05 NOA2

06-05-05 NVC received my petition

08-15-06 interview date sent

09-16-06 interview made :(

10-15-06 recieved my VISAAAAAAAA (YESSSSSSS)

11-16-06 Arrived in US

01-15-07 Filled AOS

02-01-07 Got my SSN

02-15-07 NOA1 arrived

03-16-07 my EAD issued.

03-23-07 my EAD arrived :D

06-01-07 Moved from IL to AZ, i filed the change address online form.

07-10-07 My GC arrived (it was sent to IL, but resent by USPS to me)

10-01-07 Resent the forms for change of address including my wife's

Now: Still waiting for the welcome letter to arrive.

It is possible, yes - there's certainly nothing illegal about it.

But there is always a danger that the immigration officer at your arrival port will be concerned that you may be planning to immigrate prior to receiving the K1 visa. So if you choose to do this, be sure to take as much evidence of ties to your home country (such as mortgage/rental papers, a letter from your employer stating that you're expected back at work) as you can get hold of.

Are you going to visit using VWP?

While antone is quite correct, I've noticed (purely from reading on VJ) that in countries where VWP isn't an option that a B1/2 is quite hard to get if there is a K1 going thru

Applied for K1

Met online 2001 - just aquaintances

Sept 2002 - 1st US visit - everything goes perfectly.

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received
