Timeline

Hello. My husband makes way above poverty line. However, from next fall, he is planning to go back to grad school and become a part time worker. I am planning to work fulltime.

It will be no problem if I can get my GC by then. But, it seems that some people have to wait for over a year to get GC. I applied for AOS in July 2008. I wonder if they will not give me GC if my husband becomes part time.

I should be making enough to have both. We are planning to file tax jointly. Please let me know.

06/19/2008 POE at LAX with K1 visa

06/28/2008 Married my husband

07/03/2008 Update my social security card

07/19/2008 AOS, EAD, AP mailed to Chicago lock box

07/21/2008 AOS, EAD, AP were received

07/28/2008 NOA1 for AOS, EAD, AP

08/04/2008 Biometric appointment letter arrived

08/15/2008 Biometric at Santa Ana office

10/21/2008 No update since biometric- contacted a local congressman, the ombudsman

10/22/2008 Was able to do service request

10/23/2008 EAD was approved

10/24/2008 AOS interview letter arrived

11/26/2008 Renew my State ID

12/10/2008 AOS interview approved right away

As a practical matter you should have your greencard by then... I would not worry. You have a year before anything changes...

Agreed. Even if he goes back to grad school full time, he still has the same if not higher income potential, and in an odd event that you will have to proof that, you just need to show your husband's past earning history and his diploma. :star:

Unless there is some complication in your situation, you should have your green card in about nine months after you apply. The financial support evidence must be submitted when you apply, and when you are interviewed, no additional evidence is needed -- just what you submitted at the time you applied. The only relevant evidence will be joint bank account statements, joint rental agreement, joint utility bills, etc. etc.
