Beneficiary’s passport/ UK Travel Doc /Asylum in UK

Hello everyone.

I have some questions and maybe some of you have run into this or know something we don't. I sent in my petition on July 1st and it should be approved (hopefully) about DEC. Therefore I am trying to get my love to gather the necessary items so we can be ready.

Our dilemma:

My fiancé is a citizen of Croatia but lives in UK with the status of the legal right to remain. He received the legal right to remain about 7 years ago claiming asylum. He has sent in his application last March for his British citizenship however this process is long and we don’t wish to wait to be together.

Since he has asylum from Croatia he was told he cannot have Croatian passport. Instead he was given a travel document (that has look and feel of passport but isn’t). This document lists his country of origin, his identity, and his status.

I was reviewing the FAM trying to figure out what would help with this (to meet passport requirement.) Please see following two links.

I would think after reading these that his UK travel document should suffice (in place of the Croatian passport)

I am a bit nervous to have him try to obtain his Croatian passport which would be against his agreement of the asylum.

Has anyone encountered this? Or could anyone tell me what he or she reads into this. I could appreciate any advice/ thoughts.

June 2006- my love was denied the visitors visa to USA

Aug 2007- visited my love in UK and became engaged

July 21, 2008- sent in K1 packet to California service center

July 26, 2008- received by California service center

Aug 2008- visited my love for 2nd time

Normally, Travel documents can be used instead of Passport. Just to be on the safe side contact the US embassy in London to get a final answer.

Thanks for your answer. I have made an info pass for my area for tomorrow and my finance will be phoning US embassy in London on Wed. I will post our findings here so someone else going thru this will have some ideas.

Thanks for your answer. I have made an info pass for my area for tomorrow and my finance will be phoning US embassy in London on Wed. I will post our findings here so someone else going thru this will have some ideas.

Just to update in case anyone else goes thru this. I made a info pass appointment and they directed me to phone the port of entry. I phoned CBP at the Detroit office 3 times. I had a person say no right away with out hearing me out that the UK TD wouldn't work.

Then I spoke with 2 individuals who replied yes, of course it would work if it was an official document from the united kingdom.

At any rate we are speeding up the UK citizen ship- this leaves me with another question on if the beneficiaries citizen ship changes- and since the UK and croatia both allow dual citizenship, I am wondering if he will still need a croatian passprt once his UK citizenship goes thru. Or does it have to be a passport from the country I listed on the petition.

I have a feeling I already know the answer.

As far as I know, you don't need a croatian passport. Not particularly for this petition, but because a Croatian is not required to own a passport ever in their life. A 'domovnica' proves your citizenship and that should be more than enough.

Again, as much as I know, Croatians with dual citizenship need only one travel document (in this case passport) for traveling purposes. And it's up to them to choose which one they want to use - you can own both, of course, and keep switching between them.

I'd assume next to no one there would know enough English to explain the process for you (hopefully they have some information on the website), but I guess your fiance speaks Croatian...

i dont think anyone is being particularly "clicky" i would post advice to you if i could but i have no advice to give you regarding your question,

We as well are a VERY small number of the actual K visa people that go through the process. We can only answer what we know. Often times people ask us questions that no one has had that situation before.

When you first posted, that's what you asked for. You hoped someone might know more about this situation than you did, and said you hoped someone on here had been through this. I've been on VJ for several years, and there are very few requests for information if any for the information you requested. Your situation is very unique. As well, posters are not necessarily from the USA, many are from the county of immigrating.

Your comment about things being clicky will probably only ensure that no one will now reply to your ungraciousness.

You're always welcome to post here. You didn't hurt my feelings at all. My attitude was in direct response to you making a derogatory comment about the site being clicky because you didn't get more responses, or what you were looking for. I explained why you may not have gotten what you wanted...your situation is clearly unique. I really hope you can find more answers, and that things work out for you! We have all agonized over being with our loved ones as quickly as possible. I know that can make people anxious, but people truly will help you, if they can. If they can't...they will either not respond, or respond with what they know.

I hope you're just grouchy at this whole process because that was uncalled for. You ask a question that people at the info pass appt and border patrol DIDN'T know and get annoyed because no one here answered your question. If you have a situation that someone has seen before, we are all willing to help, but its pretty standard practice around here to NOT answer if we dont know rather than post what we think since that could have serious repercussions. Thank you to all who did answer me. I am very much appreciative of your help and the time you took to answer me. Its been hard trying to find answers and getting conflicting ones when I do get an answer.

To those of you who took my comment and only answered to the fact I thought that this site is clicky. My apologies. I even posted my findings to help anyone else in my position so I am no way ungrateful to the process of how this site works. By the way- the fact that my question was viewed 159 times was cause I kept coming on viewing it and coping and pasteing my question in emails to officials and that sort. Just FYI.

But one little comment makes me grateful, grouchy, and told that my actions are uncalled for. I am left feeling like I have to defend myself. You all are like a pack of animals attacking me like I said something extremely offending. Its my opinion and maybe I find being told I am ungrateful when I have already thanked the members who did answer me is offending to me.

I was looking for support from here but found something much different then what I thought I would find. My family and friends don't understand what I am going thru and I was looking forward to meeting people who knew what it was all about. With all this stress I am not much for being attacked by so many different people for a mis-step. But still- small site = click. And now there is no way I can fit in after you all jump me.

So be it. Sorry you feel this way. You should know that this is an extremely long and tiring process and you'll require thick skin to complete this process. VJ is an invaluable resource and source of support. There is a way you can fit in, and that is to just continue posting questions. There are some questions I'm sure that you'll ask that many people will know the answers to, and they'll respond.

Your choice however. Just don't bite off your nose to spite your face!
