New driver's license rule upsets some (illegal) immigrants

All the illegals here just drive anyway. They get stopped and don't show up for court. If they have the money and resources, they can get a real fake license. Hell, they all work with fake ss#'s anyway and none of the businsess owners verify the numbers anyway. Or you can be an illegal and the IRS will give you an ITIN number so you can work illegaly legally and pay your taxes. The drivers license is a minor thorn.

So when an illegal gets pulled over and shows his fake ID, what happens when the cop radios it in to the dispatchers in the communications dept for their criminal history and said dispatchers come back with it's a fake? Would be interesting to charge a fake person with a crime. The precise reason they drive 5-20 miles under the speed limit is because of the cost of getting pulled over. That's a sure fire way of getting deported.

I don't know where you live, but around here the only ones that get deported for a driving violation are the ones that already have a warrant out for somthing more serious, like failing to appear at an immigration hearing after a catch and release at the Mexican border. Here, some of them do go to court, pay the fine and go on their merry way. Others with the fake passports and IDL just don't show up.

So let me get this straight. When cops there pull people over they don't get their license/registration/insurance, don't radio it back to dispatch, and dispatch (who have instant FBI access for all criminal records) doesn't tell them their license is a fake? (assuming it isn't obvious just by looking at it)

Something is definitely wrong with your theory.

It's not a theory. It's a fact. The cops can't verify an international license, either from a specific country or an International Drivers License. They also can't run a pasport to make sure it really who it says it is. So, someone runs a red light, shows their passport and foreign license. They get a ticket and summoned to court for driving with an invalid license. The show and pay the fine, or they don't show up at all. They don't get ICE involved with the minor cases. They don't have the manpower.

Cops never verify these things. Dispatchers do.

What do you think a cop is doing when he goes back to his cop car after pulling you over? Seeing if there's anything else on you by verifying with the dispatchers.

I'd love to see this happen because if it did, Cops would be losing their jobs left and right.

What you're saying is hardly plausible at all. Especially to someone who knows how local police and communications departments work. You can thank several of my dispatcher, PO, and JIO friends for that. As well as I had a short-lived intention on being a cop. :)

The same thing happens in RI.They will only get deported if the accident is death resulting.

ICE is only called in cases that are serious or there is an outstanding warrant. I personally know of someone who was caught entering illegally from Mexico. He was from S. America, not Mexico. So he was "caught and released", with an order to appear in court at a future date. He never went. A few years later, he was stopped while driving, gave the police his real ID, it came up that there was a warrant for his arrest for not appearing in court. He was arrested, ICE was called in and he was deported several weeks later. IF he didn't have the outstanding warrant, he would have been ticketed for driving without a valid license and been summoned to court. He would not have been deported.

Whatever underground community there is here is in regards to smuggling immigrants, but they can't do it up here. It happens down south and they eventually make their way up here. However, being active in the community, and once pursuing law enforcement (I was a criminal justice major before changing to business, and pursued both police and communications department jobs, locally), I learned the trick of the trade. Ultimately though, you're right and it may be different in MA. Being a state with such high rates of illegal immigration, it isn't uncommon here to be thorough with what one might suspect is an illegal, and even then, being white and greenish blue eyes, they go through the same routing with me too. Pulling someone over they demand license, registration, and proof of insurance. They also run your plates to see it matches your identification. No ID? Give your information? No information? Go to jail until they figure out who you are and if that's property you can legally have, or if you can even legally drive. In this process, an illegal immigrant would be found out, if not right away by most illegal's inability to even speak proper English.

Natty. Being from Houston myself I happen to know that the police have arrested people with no ID to determine who they were. Now if you forgot your license and they can determine from other info like the license plate and the verbal info match and agree then they can let you go.

Also if you can't speak English then it may just possibly be that you could be an illegal. Don't have to be but it could maybe be that it needs to be checked. If you are legally here and have the proof then why sweat it?

There isn't enough jail space in CA to house all the illegals everytime they get pulled over and don't have proper documents let alone get ICE involved to investigate and deport them. I don't doubt that police are more thorough in your area, but there are much bigger fish to catch. How frustrating it must be for a cop in LA. Where I am there are thousands of illegals, CA has millions. Do you spend your resources on jaywalkers or do you go after serious violaters?

This law that one must be here legally is in response to the Federal regulations from homeland security to force states into what is called Real ID. All states must eventually move into this program. Most are up in arms about it as it is seen as a national ID card. The implications are enormous but seems most did not care and like good sheep stayed quiet.

They don't get put in jail or deported. Just like if you or I were driving without a license or registation.

They ask for a drivers license. As in, a proof that you are eligible to even drive -- because driving is not a right, it's a privilege, as I'm sure someone must have iterated by now. Now, for someone who had a suspended driver's license, don't you think not bringing their license or anything else, if that worked, would have been done all the time? Logic dictates if you don't have your license, or insurance, or proof of owning/possessing/renting the vehicle, and they can't determine by running the plates that it's really you who owns it, you need to be checked out and reminded that this is indeed the law. This happened to a Hispanic friend of mine. He was taken in. This also happened to me, but I have enough information to give the cops on myself that they verified the information (height, weight, eye color, address, etc.) and just lectured me on bringing my license (I forgot my wallet at home, as I was just driving a friend to his place), proof of insurance, etc. because I was too lazy to do it before. Of course, I still got the ticket for a "California stop", and had to go downtown to correct the lack of proof of insurance on my vehicle (to show I had insurance at the time of being ticketed).

All that's been shown here is they just do it differently in certain places. MA must not be as concerned about illegals as we are here in California.

Yes. But now a law has been passed where they can if they want to impound the vehicle until the proof comes and and/or any fines.

What happens if someone is stopped who has a foreign license and a passport for ID? How does the CA police officer determine whether it is an illegal or someone visiting legally?
