Can I bring my 18 yo daughter?

Still here waiting for NOA2 for our 1-130 & 1-129F, hopefully we get approve this month or next. I want to know if i can bring my daughter along with me or just fallow me right after this School end. She turn 18 yo (last b-day Nov 2,2007) before our marriage (Jan 22,2008) she was included when my husband filled petition. If i can, what will i do? does she need to fill up DS156? What should i do to get her a visa ? What are steps. At present she 's still studying here in the Philippines & I want her get a degree first before living permanently in the US., but just wanted her to enter US before she ageout. Her trip will be just temporary maybe during semestral break.

One more thing, My husbands income is below poverty income requirement but his brother willing to sponsor him, (already filled F 1-134), his annual income is $50,000 will this be enough to include my daughter?

I need your answers pls VJers. Enlighten me pls. Thank you in advance.

sent our 1-129F Mar 22 NOA1 received- Mar 25 touched 5/7, 5/8, 2008 - nothing fallows

Did hubby file a separate I-130 for your daughter?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thanks for quick reply, YES her name is included in both 1-130 & 1-129. My other question is, if I'll not bring her along with me ,can she just fallow me later in a few months after her sem break? What is the first step before submitting DS156 etc. Will she has to call first the US embassy here for appointment?

Haole you did not answer my question about our co-sponsor income if it is enough to include my daughter.........?

Are you going with the CR-1/CR-2 or the K3/K4?

.Hubby will need to file a separate I-130 and pay the $355 for anak. She must have I-130 approval to adjust status if you go with the K3/K4.

Looks like BIL makes enough to co sponsor no matter which visas you go with.

Since you filed for a K3 visa, your daughter will get an interview for a K4 visa. If she chooses not to go with you, you have 1 year to re-schedule her appointment with the embassy. Once you're both here, you will have to file for AOS separately.

Also, I think I read that your daugther wants to get her visa, stay here a little and then go back to finish school. Remember that a K3 visa is not a tourist visa to go back home and come back whenever you want. It's meant for the beneficiary to reside in the US.

And last, check out the Poverty Guidelines to see how much a sponsor or co-sponsor need to make for visa approval.

Diane, did you mean that once she is in the US & applied for AOS does it mean she has to stay & wait for approval? How about if she just stay 2 mos then come back here in Phils to resume classes & hubby will just apply for her 1-130.
