To those who had their petition lost...how did you find out?

How did you send it? If you sent it with a delivery confirmation with USPS or have a tracking number with FedEx, UPS or other. you should start there and have them open an investigation (that's what I had to do with UPS). It will take a few days to complete but you'll know either way.

UPS with confirmation. Thanks for the next step. In the interim I've redone all I'm paperwork that requires original signatures and sending it to Jeremy today probably after work...lol well this just sucks. Guess it's safe to say I'm no longer an October filer!

I've started planning stuff which isn't affected by the date of our wedding. Today I started to draw up an invite list for the wedding and BBQ afterwards. I've also started to make my invitations, I'll just leave the inserts until we have a date and location. I'm also looking at the cost of rented tuxes for the best man, though I feel like letting Tom sort that out. Tom is lucky as he will be wearing uniform.

Are you able to use USP tracking to find the package? Was it sent from within US or from Canada?

Although occasional losses may occur, this seems uncanny that more than 3 people have had their petitions lost in the past month; especially since all three were headed for VCS.

Looking at your signature, it says that it was received. Have you contacted USCIS yet?

It was sent by UPS in the US, the package was confirmed as received by VSC. We called they said they couldn't tell us anything over the phone and even if they could they couldn't help without a case number. They told us to be patient :) So Jeremy has sent in a request for information. lol I mean all we want to know is that our file is sitting in a box somewhere not in some sort of lost petition hell.

Looking over other's timelines, there have been many people who waited over 2 weeks for their checks to be cashed/issued NOA1 (they seem to occur concurrently). I like what you originally stated about not panicing until a month has passed. I say give it this week, if still nothing, then you can take aditional steps. During that wait, you can contact UPS and double check that it had indeed been received at VSC.

Oh, a thought just popped in my mind. Did you happen to note on the outside of the package "I-129f Original Submission" or something like that?

lol No...damn was I supposed to?

My guess is it's probably floating around USCIS somewhere, though the first they do is open it to get the cheque so they would see which department it would have to go to.

It is highly recommended that all future paperwork (whether refiling petition, or any other) have the exact nature of its submission, both on the cover letter and the envelope. This makes for much faster sorting.

I cannot say for certain whether that is the cause of the delay, but it certainly did pop into my mind as I was responding to you.

We're thinking of traveling to the Caribbean, where my parents live, to get married on their island. I've already given close friends/family some notice, so that if everything goes through, they may join us. Originally I was hoping to get away with eloping, however it seems like a proper wedding is in the works.

Have any other October filers begun wedding plans?

I WAS an October filer but we're re-filing late this week...but - we were going to have our big wedding next year September but due to the delay with paperwork, we've decided to have a civil wedding next year then have our 'proper' wedding celebration in May 2010. We have booked our reception hall and will be having it in beautiful Chateau La Mer in Long Island, NY.

Sorry I didnt check that thread yet, when i'm too sad about this progress i hate to go in here :P

But as for now we sended it in 2 days ago, I have the tracking number and everything will be fine, it shows that it should arriave at vermont on 4th November, but I still count myself as October filer after this long and hard journey already so far xD

But i'm very sorry to hear that the same thing happend to you, did you also use vermont? Remember to send it via fedex or something and get the tracking number, we didnt do it before and its such a relief to know where our papers is at in the world.

We never used any layers, but did it all ourselfs, but I hope that it will work out this time for both of us, keep me updated!

I agree – hence the reason why I’ve avoided VJ for a while. My documents reached the US today so my fiance will be picking it up Monday and send it off on Tuesday. As mentioned before, we didn’t know the whole process and we were referred by one of our friends of this lawyer who had a great experience with them so we decided to retain their services. They were just ridiculous- but im not going to go into details as it frustrates me thinking about it! :angry:

We’re Vermont filers also and my fiance will be sending it via fedex so really optimistic about this third time filing lol. Will definitely keep you posted!

This is a bit off topic, but thought I'd share the story.

In the days leading up to the arrival of my fiancee's paperwork from Thailand, I methodically gathered all remaining paperwork for the petition and reviewed all forms three, four, fives times to ensure accuracy and free from errors. The day her package arrived, I went to the post office to pick it up. While there, I noticed I could get passport photos for the G-325a, which was one of my remaining tasks. I went in the back and had the first photo taken. I explained to the lady that I was not getting this for a passport, rather to bring my fiancee to America. She found my tale to be romantic and we discussed it briefly while waiting for the photo. When it came out, I noticed the light reflecting off my glasses, and asked "Would that be acceptable? I remember reading in the guidelines that the photo could be rejected." She said, "Let me go ask the expert." She came back a few moments later with another lady, who said "To be sure, you should take it over." The first lady commented, "We gotta get this right, so his fiancee can come over as soon as possible!" They did another one, which came out better. They gave me both at no additional cost, wished me luck and bid farewell.

The next day when I took the I-129f petition to a different post office, I also mentioned what it was for, and the lady there also expressed a sincere interest in our story and wished us all the best. She made a cute comment like, "Make sure this gets there safely Robert. This is for his fiancee."

These two experiences overwhelmed me with gratitude for all those around me. Yes, mistakes are made. Yes, some people do go out of their way to do harm. Regardless, there are still a lot of decent folks out there who are quite supportive of others (especially when they see one's own good nature). I consider many on this board to be among those who support. The wisdom and advice has not only helped us, but countless others before and after us. I really do appreciate all that you do (you know who you are!) to collectively assist all of us through this process.

It took longer than expected to receive any confirmation so we followed up our lawyer and USCIS and they kept saying it was sent back....but never heard anything.

We sent our K-1 packet on October 16th, my birthday! I was hoping it would bring us luck. So far so good recieved first NOA! :dance:

Not sure how many of you have dug really deep into this site, but I stumbled upon this older VJ link from a former USCIS adjudicator who describes the process from the inside. If you haven't read it yet - its a bit illuminating. The fact that he also went through to process is also a bit reassuring as we all settle in for the long wait.

There are people who waited for 30 days to get their checks cashed.

Just as an FYI - Vermont takes a little longer on NOA1's, I don't know exactly why but that's the case. But hey, they are faster with NOA2's...
