Hello !! I don't know if somebody has gone through with this situation, but I feel so frustrated because I am no a citizen yet, but my husban is. I had my baby in february and I invited My mom and My dad, however My dad passed away on 10th february so My mom didn't want to apply for the visa after that and before either because she took care of him. My Mom applied for her tourist visa finally but she got denied , I sent an invitation letter with my name and my husband with our phone numbers. She is no retired she took the court to the Institution which doesn't want to give her retirement to her...anyway I support my mom and what the Consul said.....She doesn't have money because she depends of me, however she owns her house , she doesnt' have granchildren in Peru and i have only one brother in there, but she needs ties.....she has her mother in there, sister, nieces, nephews so My mother in law wants to sponsor her with my father in law, i don't know if i could change....i am concerned because my mom is widowed , she has only one son and i don't know if you could suggest me something else and then she can take the papers from the Court so she needs to be in my country as well....Ideas pleaseeeee!

I'm sorry, but your post does not make much sense. Perhaps you could punctuate a little? But, if I understand you correctly, your mother was denied a tourist visa because she did not prove sufficient ties as to overcome the presumption of 'immigrant intent'? What documents did you mother take with her when she applied for her tourist visa? If she owns her home, did she take documents showing ownership? You say your mother is still employed? Did she take documentation from her job, showing that she is employed and will be expected to return to work after she returns from her vacation? Unfortunately, tourist visa denials do not have an appeal process....perhaps you can gather more documentation, showing your mothers ties to Peru and apply again.

Alternatively, and if this is your wish, once you attain citizenship, you can file for an immigrant visa for your mother.

Good luck,

-P

THAT IS RIGHT, SHE DOESNT' WORK SHE IS 67 YEARS OLD, SHE TOOK HER TITLE FROM THE HOUSE , SHE DOESN'T GET PAID BY THE GOVERMENT FOR HER RETIREMENT BECAUSE SHE TOOK THEM TO THE COURT TO FIGHT FOR HER CASE , BUT I DON'T KNOW WHAT KIND OF THINGS SHE COULD PROOF AND SHOW THEM THAT SHE WILL COME BACK...HOW I PRETEND TO BRING MY MOM HERE AND SCREW UP MY STATUS IN THIS COUNTRY, FOLLOW THE RULES, PAYING ALL THE FORMS AND EVERYTHING IF SOMETHING HAPPENED TO HER MOM OR MY BROTHER I WOULDN'T KEEP MY MOM HERE FOR ANY REASON THAT IS NO HER FAULT THAT MY BROTHER IS STUDYING AND HE DOESNT' WANT TO HAVE CHILDREN YET AND THAT HER FIRST GRANDSON WAS BORN IN THE USA... I AM REALLY DISAPOINTED

Probably the best bet would be for you to go and visit her.

Your Mother could wait a while and try again, but from what you have said she has little in the way of ties to Peru, and you are her support and are in the US.

This is very normal and I've known many people who have very good jobs, plenty of money in the bank, own their own business and were still denied. The invitation letter you wrote and the fact that your husband is a US citizen means absolutely nothing to the embassy, some COs might consider it but most don't.

Your mom can try filing again and going back there with more proof of why she needs to go back to Peru after visiting you in the US but having family there like sisters and even her son is not enough.

Hi,

My mom was also denied the first time (Philippine Consulate) then we applied after 2 months again and then the consul told her she's just wasting money and just wait after I get my Citizenship. We applied again after a month and this time she was approved and the consul gave her a 10-yr multiple visa entry. Now we are in the process of asking for extension for another 6months.

try bugging them if they give in!!! Until they see that your mother is really interested in going here, I think sometimes they just need the money to generate income :-) We pay non-refundable fee of $130 per interview.

She has been here 6 months and you want to extend her vacation to 12 months?

There is another thread going about somebody who used a B for her Brother to live here.

And you wonder why they can be difficult to get.

Wise words Boiler.

As for the OP - your mom appears like a high intent to immigrate risk for the CO - I am not saying she is one, but being over 65, widowed (my condolences on your dad's passing) and with no income is a high risk. Sorry.

sorry about your mom's visa denial... it can be very frustrating... my mom got denied for a tourist visa 4 times even though we showed enogh evidence that she's going back to the philippines... it got my mom so depressed that she didn't want to apply for a visa again... after i got my citizenship, i petitioned her and she was approved for the immigrant visa...

your mom can try and try and try again for the tourist visa until she gets approve (if money is not a problem) or you can petition for her after you get your citizenship...

Hey I think you don't know the all the reasons for the extensions why we applied. First, her first granddaughter's first birthday is January 23rd and she still has to visit her long time friend for more than 10yrs of not having seen each other.... NOT everybody wants to LIVE HERE!! There are other better places on earth to live. DUH!

I think it would be better to know the all the premises before saying something.

Where do you draw the line between visiting and living?

For a B it is 6 months which most people would I think is a very long visit.
