Hi all!

I just came across this Web site today and found it really interesting and helpful.

I am an F1 student but got married with my wife back in December last year. Since I'm not in a hurry to change status yet, we didn't think of filing papers for GC immediately. Now, we want to do so but lawyers fees are absurd, so we are trying to put everything together and send to immigration before this year is over.

I have a question now, and it's she had a kid before our marriage with another guy (8 years ago), who now is my stepson of course. Do I have to include his birth certificate or indicate anything related to him on the documents that need to be filed to immigration? I'm not his father, I do have responsibilities towards him, but not sure if for AOS purposes I need to submit any evidence of anything.

If any of you here had the same experience, I'd highly appreciate it if you gave some advise so I can put all my papers together and not miss anything out.

Her son has nothing to do with your adjustment of status, so you DON'T need to include his birth certificate. The only time he will even enter into the equation will be when she is filling out the I-864 to sponsor you, the houshold size will be 3, instead of 2. So her income will have to be a little higher to be able to support 3 people, instead of 2. That's all.
