Card production ordered but EAD still have a problem

I-485 AOS transferred to USCIS - California on Aug. 27, 2008. And today got an e-mail, it is said that yesterday (Oct. 08, 2008) they ordered production of new card and allow 30 days for new card to mailed to me. :)

My problem is, until now i still don't have EAD because of the mistake that we did, i denied. I filed I-765 through e-filling, while i have filed an 1-485 AOS, so it was filed subsequent to the filling of I-765 application for EAD. Therefore, I did not have an application for AOS pending with the service at the time I filed the application of EAD.

What does this mean?

Pursuant to Title 8, Code of Federal Regulations Section 103.2( b )(12) you are ineligible for work authorization at this time. Your application for work authorization, filed under Title 8,Code of Federal Regulations, Part 27a.12 9 c )(9), is hereby denied. There is no appeal to this decision. This decision is without prejudice to consideration of subsequent applications filed with Citizenship & Immigration Services.

But before my application for AOS transferred to USCIS-California, I sent the documents they requested for initial evidence and I attached again I-765 application even if they didn't asked hoping that they will update my EAD application. :crying: Everytime i go online the message is still intact, denied and no updates.

What will i do next step? Do i need to re - apply or re-submit the form I-765? Is there a service charge or fee for re-apply? What are the documents do i need to attached?

I really need to get a job because i'm tired sitting all day and earn nothing and couldn't help my husband financially. And i'm also worried because my husband might lose his job. :unsure:

If your AOS (Greencard) has been approved and the card has been ordered then you will have it within a few weeks. Once AOS has been approved you do not need EAD. so there is nothing to do.

Your AOS has been approved. Your GC will arrive shortly. You no longer need and you no longer can apply for and EAD.

If that so, i relieved. Thank GOD... I cried the whole last night because i called Customer Service yesterday and advice me to re-apply and i told about this to my husband and he said to call again and find someone who can help me to fix it that no need to re-apply.
