I've gone on many websites regarding Advance Parole and I'm still confused!! I need to know what avenues I can take to ensure I get this before I leave Canada (or at least know exactly what to do when I move to the States). Number 1.......My Dad is 97 - Number 2....my daughter is expecting her first baby in August, so I need to be able to go whenever possible. I know I can get 'Special' permission but not sure how to go about it! If any of you fine folks have been through this, I'd appreciate any feedback. Thanks...........{{{{HUGS}}}}

June 25, 2004 - Bruce & I met through mutual friends in my hometown in Newfoundland the night before he was going back to Maine

July 1 - First email between us

July 3 - I called him to wish him a Happy Independance Day

Daily phone calls and emails from there on in

October 20 - Bruce drove back to Newfoundland. He planned on staying a week but it ended up being 3 weeks. We knew for a fact we were in love!

March 19/05 - Bruce back in Newfoundland

April 8 - Bruce picked me up in North Sydney, NS and we drove to Maine. I stayed for a week due to work

July 26 - Bruce back to Newfoundland for another 3 weeks. I can't bear to see him leave.

August 10 - He asked me to marry him.........I had already asked him anyway just to make sure*_*

September 30 - I flew to Boston to meet Bruce there and then we drove back to Maine for 2 weeks

November 18 - We filed I-129F

December 1 - NOA Receipt #

December 28 - Received Packet 3

January 6/06 - Received my Police Certificate of Conduct

January 11 - Sent DS-230 Part 1 back to Montreal Consulate

February 3 - Sent off my check list to Montreal Consulate

March 24 - Medical

April 5 - Interview Date.....APPROVED......Yahoo

April 17 - Moving to Maine

May 16 - Bruce & I became Mr. & Mrs. in Las Vegas (Oh HAPPY DAY)

REMOVING CONDITIONS

11th Aug 2008 - Mailed I-751 to CSC.

12th Aug 2008 - Application received

14th Aug 2008 - Cheque cashed

18th Aug 2008 - Received NOA-dated the 12th

26th Aug 2008 - Received Biometrics letter

4th Sept 2008 - Biometrics-Detroit-Complete-'Touched'

5th Sept 2008 - 'Touched'

1st Dec 2008 - APPROVED-Card production ordered -112 days

8th Dec 2008 - USCIS mailed approval notice.

8th Dec 2008 - Received my 10 year Greencard in the mail. took 2 days.

Although I have the above date for approval my card actualy states the

2nd December..

Check out the old forum as well. Lots of good info with the search button.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Thanks for your replies but I guess I'm hoping somebody out there 'been there, done that' :( I've called Rainbow Bridge.....border control.........they are just the greatest.........if they don't know the answer to something, they will try to direct you to the right source. They have given me info (eg.. the form # for Advance Parole). What I will do is get Bruce check it out on his side.

Again I think this is the greatest site. There are things I thought I was doing right until I read something in here. For instance, I got my Police Certificate done in January (something didn't look right on it from others I read here). So I called Montreal yesterday and sure enough.......they didn't include 'national search' on it and didn't have my married name there. Even though Montreal did tell me that there is a RCMP there who can do my search but I would rather have it all done before hand. So I will call my local RCMP today and get them to redo it. Don't want anything to jeopardize the Interview..... :no: {{{HUGS}}}

You apply for AP the same time that you apply for AOS by including a I-131 with your AOS packet. YOur AP will be processed by the NBC. It usually takes about 3-4 months for you to receive the AP.

That's where my concern is because of my Dad and my Daughter. But keep them replies coming please.........thanks..{{{HUGS}}}

You can request an emergency AP from your district office. However, the DO is under no obligation to issue them and if they are issued they are usually for a dire emergency like a death or imminent death. All you can do is make an Infopass appointment and try, but don't go in there with any false hopes that it will be allowed.

Hi,

As you may or may not realize, the ONLY way to get any kind of advance parole when you come on a K1 visa is to have been married already and your AOS application filed. If after the filing of the AOS, you have an emergency situation, you can schedule and infopass appointment with your local office and plead your case then. I am not sure what the USCIS consitutes as "emergency" to get an interm AP, but somehow I doubt your daughters delivery would be. It is pretty standard that AP is taking 60 days minimum, so I guess your dilema would be if you have enough time after your visa is issued.

I notice from your timeline, you just sent back your package3, you can count on probably 2 months from the time they recieve it to your interview (seems pretty standard with montreal). That would put you into April and if you could come to the US right away and get married and file your AOS (within the month of April), that would leave you with 3-4 months for your AP to be processed. So it sounds to me like it could be possible to get it before Aug, but you won't be able to waste any time getting married and filing AOS once you recieve your visa.

Keep researching on this site, it really is a godsend and has helped me tremendously in understanding the ins and outs of this immigration process.

PS. you were lucky to go through vermont for the K1, 17 days to approval is incredible. Unfortunately in the AOS stage, all is equal (going through chicago) and it's luck of the draw how fast stuff is approved.

Thanks, Danette, yes this website is a God send! We were very lucky to have been processed in such a short time........really it was from Nov 18 to Dec 1 (we noticed we were approved on line first)..........13 days. When I was talking to Rainbow Bridge (border control) I was told there are 'special' circumstances for AP. There's always a loophole. And I'll keep searching until I find one :yes: Thanks again...............{{{HUGS}}}

Please be careful with the information you get ANYWHERE. Here on VJ, from the border people, from the embassy.

Unless the person answering the phone is the one you have to deal with in the situation you are describing, you may face difficulty. For example, the border guard you spoke to may have seen the forms he spoke of, but in actuality the guard you see may not and deny you. Many times people call the info line and get wrong information. I have called them twice on the same day with the same question and gotten different answers.

Good advice from daisy. I do recall (maybe I was dreaming) of one Canadian gal on a k1 that went back to Canada without AP, and she had done it numerous times with no problem, and then on one occasion they denied her entry then had to stay in Canada and had to start from the begining with a k3 or a cr-1 visa!! Hard to get solid advice over the phone, and even face to face. Best of luck

Thanks for replying. Yes, Flames, that is my fear of not getting back into the States and having to go through the whole process again. I wouldn't even venture trying it unless I had papers in hand. (Bruce & I have waited long enough to be together and we don't want to jeopardize it!!)

And you're right, Daisy, about getting information from here, there and everywhere!! I've run into the same problem. Thanks for everybody's help. You wouldn't think wanting to get back into your own country would be such a big deal (or returning to the US I should say, after being approved!!) :crying: ..........{{{{HUGS}}}}

Just to add words to the words of caution

- when I crossed the border the guard said... hey you can cross the border to Canada anytime you want! You can imagine how much I wanted to believe him! I called to confirm this and was told... if you do - you might not be allowed back into the country.. so...

This whole process is a bit unpredictable. We started the process in March of 2004 and got our approval by July for me to move to the US! We thought we were on a roll. We got married in September and sent them the request in October. Ever since then, we've been on the slow track to nowhere. I have no clue why. But, we have had to wait until last week to get notification for the fingerprint appointment which will happen on the 22 of Feb! The Immigration TimeLine states that it can take another 187 days before the interview!. I am 5 1/2 mos pregnant and so wanted to go visit my friends and proudly show off my new 'state'. IT so doesn't look like it is going to happen

On the other hand, you can luck into the 'fast track' at all stages!
